Dookeran: More UNC people coming to COP

Recent developments in the UNC will see another 25 per cent of its membership coming to join the Congress of the People, according to COP leader Winston Dookeran. “We will continue to have dialogue with all political and civic groups, aimed a setting the stage for real national unity,” he said. He told the monthly national council meeting of the COP at its Operations Centre in Charlieville yesterday that one of the gatekeepers had fallen by the wayside, and whilst the other gatekeeper built tall walls, he, too, was falling apart. Dookeran said the Congress of the People would survive because it was not founded on the racial divide, but remained an all-inclusive party aimed at the total reconstruction of Trinidad and Tobago. He said the COP was moving with a greater intensity, dexterity and force to manage the affairs of T&T when the time came.

He said he saw no fallout, following the new leadership at the UNC. “There is a new enthusiasm, new vibrancy,” Dookeran said. He said that there had been discussions with the National Joint Action Committee (NJAC) on the reformation of this country's politics, and he had also sent copies of COP’s “Fixing the Politics” to Kamla Persad-Bissessar and Tobago’s TOP. He said there were three basic views under study—the battle to fix the politics in TT; the politics of change that this opportunity has given us; and moving forward as “a nation, so that we can remove ourselves from the imprisonment of the gatekeepers that have kept our modern politics in a state of siege.”

COP will commence the screening of interested candidates for the forthcoming Local Government elections, and it will resume its Meet-the-Constituency visits from Febuary 22. Additionally, the party’s national executive elections will be held on Sunday, June 6. All the posts will be up for grabs, except that of the political leader who holds office for three years, and whose term expires next year May. “It is going to be one man, one vote,” according to Roy Augustus, COP’s chairman. Additionally, there will be a special meeting of COP membership on Sunday, March 7, at the SWWTU Hall, Wrightson Road, Port-of-Spain. Dookeran said the COP would continue to work with all the people of T&T to improve the quality of life, security and good governance.

Hunt apologises for $2m stadium flag fiasco

Five months after its erectionÂ at the Hasely Crawford Stadium, the Minister of Sports and Youth Affairs, Gary Hunt, has finallyÂ bowed to public opinion, conceding that theÂ $2 million flagÂ was a graveÂ error.

In anÂ address to the nation last night, which focused largely on the accomplishments of his ministry, Hunt admittedÂ thatÂ while the idea of the flag was noble, it wentÂ all wrong ’inÂ its implementation’. Furthermore, he gave an undertaking to the country that never wouldÂ this happen again.

’My fellow citizens, although the Ministry of Sport and Youth Affairs continues to make great strides and has enjoyed considerable success, we have not always got it right. There have been a few missteps along the way and one of these has been the construction of a national flag at the Hasely Crawford Stadium. The proposal to erect a national symbol at a facility that bears the name of our only Olympic gold medallist was a noble one but there were errors in its implementation,’ Hunt said.

’We have heard the public’s concerns and have acted appropriately. I have since directed the Sports Company to adjust its systems and policies to ensure that nothing like this occurs in the future. A national flag should never become the source of conflict and controversy and I wish to assure the national community that it will not happen again.’

ThisÂ isÂ a majorÂ turnaround for Hunt, who, at a press conference held with senior members of the Sports Company in September last year, stoutly defended the decision to erect the flag.Â He said thenÂ that he had received tremendous support on his Facebook on the issue.Â

But in reality, the flag has never gone down well with the population and theÂ matterÂ has continued to provoke criticism and has even been the subject of negative comments in calypso.

Hunt’s shift in position also comes amidst a growing sense of unease within the PNM, having regard to what has transpired within the Opposition UNC and the emergence of Kamla Persad-Bissessar as a bright new star in the political firmament.

In his address, Hunt saidÂ it wasÂ clear that the country wasÂ on the verge of a golden era of sport in Trinidad and Tobago.

’The many successes that we have enjoyed in the last two years are just the tip of the iceberg and the best is yet to come,’ he said.

He said the ministry recently finalised a comprehensive and systematic plan for the future development of sport entitled ’The Way - Pathways to Sporting Excellence’.

’I am confident that this new plan will take Trinidad and Tobago to the highest levels of international sporting glory,’ he added.

Hunt announced that the Sports Commission would be established soon and thatÂ the ’highly successful Elite Athlete Assistance Programme’ would be expanded ’to include an even larger base of talented citizens’.

In terms of youth development, Hunt saidÂ Government intends to implement 48 more sustainable community youth programmes throughout the country this year.

Saying, however, that Government recognises ’that more work needs to be done’, Hunt said, ’I wish to assure the national community that we shall not shirk this responsibility. Working together with communities, youth groups, schools, as well as our national sporting organisations, I have no doubt that we will scale even greater heights in the months and years ahead.’

End of UNC Monday Night forum

DESPITE her painful injury, UNC political leader Kamla Persad-Bissessar launches a “Meet the Constituency tour” tonight in the heartland of former political leader Basdeo Panday’s Couva North constituency.

The meeting replaces the traditional UNC Monday Night Forum — which was conceptualised by Panday — to sensitise UNC supporters every Monday on national issues. The forum, however, has not been held since the UNC announced internal elections in early December last year.

Panday told Newsday yesterday that he has not been invited to tonight’s Meet-the-Constituency tour although he is Opposition Leader and the Couva North MP. The tour will begin at the Chandernagore Presbyterian School from 6 pm. Panday had voted in that school in the January 24 elections, but lost to Persad-Bissessar by over 12,000 votes for political leadership of the UNC. Yesterday, he said: “I have not been invited, but I will see how the meeting develops.”

Asked whether he will launch his own parallel meetings, Panday said that it all depends on how the new meetings of the newly-elected UNC executive fare. “I will see how they develop and if it becomes necessary then I will, or, I will not,” Panday said.

Neither Persad-Bissessar nor new party chairman Jack Warner were available last night to comment on why Panday had not been invited to tonight’s meeting in his own constituency.

The discontinuation of the Monday Night forum further widens the ongoing rift between Panday and the newly-elected executive led by Persad-Bissessar.

But pressed for a comment on tonight’s launch which is in the Couva North constituency heartland, Warner, who is UNC chairman, stated, “We, this new executive, never had a Monday Night Forum. That was a Panday initiative. This new executive will not be having any Monday Night Forum.

Kamla will instead be going into the constituencies and meeting the people and getting first hand information on their problems.”

A release issued yesterday by Warner stated, “We wish to announce that the party’s leadership ‘Meet the constituents tour’, shall commence on Monday February 8, in the Couva North constituency, at the Chandernagore Presbyterian School from 6 pm.” “These meetings are intended to be an ongoing exercise as we seek to construct the bridge between the people and the leadership.

It is our answer to the call to bring people closer to the governance.” Persad-Bissessar, who was injured when she fell in the Parliament chamber on Friday, will be the feature speaker. She spent yesterday resting at her home in Siparia for most of the day.

Asked yesterday whether he will bow to Warner’s request to allow Persad-Bissessar to become Opposition Leader, by no later than next Wednesday, Panday said: “The office is not something to hand over. I can’t hand over any office. If they have a letter they should send it to the President who will appoint a new leader of the Opposition. As it is now, I have not being informed by the president.”

WASA starts rationing

THE WATER and Sewerage Authority (WASA) yesterday announced a national rationing plan in order to conserve the country’s dwindling water reserves, saying it was the only way to ensure customers have at least a supply they could survive on during what seems a tough dry season ahead.
Also, as of Wednesday morning, there will be nationwide restrictions on water use. Customers found breaking these restrictions, which fall under the Water and Sewerage Act, will face fines of at least $80 or $90 per offence.
Repeat offenders who leave sprinklers on excessively, religiously wash their cars with hoses, and refuse to take responsibility for their actions where water conservation is concerned will be further penalised, WASA corporate lawyer, Dion Abdool, said at a press conference at the company’s St Joseph headquarters yesterday.
The restrictions will be published in the press before they take full effect tomorrow, WASA officials said. The authority’s police will be on patrol once the restrictions are in effect.
WASA officials said given the low rainfall levels of last year, and further dry conditions this year, water will be redistributed from areas with regular supplies to those with irregular supplies.
’There will be a redistribution of water,’ WASA CEO Dr Jim Lee Young said.
We started with a dry wet season ... the levels in our reservoir are lower than they should be for this time of year. And we still have to enter the harshest part of the dry season.’
He said total rainfall for January was just over 30 mm, more than 40 mm less than the Meteorological Office had previously predicted. He explained that ’certain areas of Trinidad are blessed with water’.
’We will start moving water from those areas, for example the north-west part of Trinidad, and sending it to areas with less,’ he said.
He said water from areas like the Diego Martin and Tucker Valley area will be moved eastwards. Lee Young said this would then displace water from the Caroni area and the displaced water will run further into WASA’s system and be fed to other areas within the network.
The CEO said while WASA has its job to do, citizens also had to do their part in conserving water for everyone in the country by fixing things like leaking pipes and rotting tank floats.
’We are now asking our customers to respond,’ he said.
Company chairman, Shafeek Sultan-Khan, also said customers could soon expect to get WASA meters. ’We are going into universal metering,’ he said.
While Sultan-Khan said WASA had its own share of fixing to do, he said once people had meters on their homes they would be more willing to fix leaks quickly and save water more efficiently.

Ramesh: Kamla should rethink chief whip

Tabaquite MP Ramesh Lawrence Maharaj is hoping that UNC leader Kamla Persad-Bissessar reconsiders the process of the appointment of chief whip. Maharaj said he received a call from Persad-Bissessar last Thursday asking for proposals for a chief whip. “I told her that is was my view that she ought not to change the status quo until she got a consensus of all the Members of Parliament.” Last Friday, Maharaj said he was surprised to see that Persad-Bissessar appointed Jack Warner as chief whip. Maharaj said he later found out that some of his colleagues were never consulted on the matter. “I am hoping that sister Kamla would reconsider this matter with the members because as a party in Parliament we should try and stay together. I am prepared to help.” Unless there is a consensus, Maharaj said the UNC can lead to problems in Parliament. “I think errors can be corrected and Mr Warner has a large heart. I am sure that whatever happened would be in the interest of Parliament.” (SH)

Ravi B crowned youngest Chutney Soca Monarch

RAVI BISSEMBHAR is the 2010 Chutney Soca Monarch. He was declared winner before a mammoth crowd at Skinner Park, San Fernando, early yesterday morning.

At age 27, the popular chutney artiste, whose stage name is Ravi B, is the youngest winner in the history of the 15-year competition.

Singing “You Know Ah Was ah Drinker”, Ravi B made a dramatic entry on stage at 10.15 pm carried on a sofa by members the bmobile Shiv Shakti Dance Company. He was accompanied during the performance, which was filled with dance and drama, by Barbadian soca star Allison Hinds and his sister, popular chutney singer Nisha Bissembhar.

The new Chutney Soca Monarch credits popular music producer Big Rich, (Zaheer Khan) of the Pungulungs Factory for his success.

“He is the mastermind behind this song. I was just lucky to get this sweet melody and rhythm from Big Rich,” he said.

The song was written by Kevin Kissoon, of Piarco, who gave the lyrics to Big Rich. The producer then chose the music and experimented with various singers.

“Ravi has a youthful and playful disposition. I believe the melody and lyrics suited his personality,” Big Rich said he celebrated the song’s success early yesterday morning.

The new monarch, who is booked to perform every day until Carnival Monarch, has won $200,000 in cash.

In winning the title, he edged out a favourite in the competition, Rikki Jai, a former monarch, who had to settle for the second prize of $100,000. Jai’s song “Barman” has been ruling the airwaves in the recent weeks and has earned him a spot in the finals of the International

Groovy Soca Monarch.

In third place was newcomer, Moses Charles, 21, with his composition “Indrani”. Since the release of the song, Moses has been in big demand to perform at fetes and is booked for the biggest chutney shows of the season.

“I know people enjoyed the song but coming up against the big names in chutney was really a nerve wracking affair,” he admitted.

Charles also credits Big Rich for helping him develop the hit song.

“Although I was responsible for choosing the music to go with my song, Big Rich polished the tune to a certain perfection so it became an instant hit,” Moses said.

Big Rich had a hand in the three top songs in the competition and worked on 11 of the songs in the finals, including Omadath Maharaj’s “The Night Before the War”. Maharaj, who performed the military-style song accompanied by the Primala Dance Company, placed fifth.

Another newcomer, and the youngest competitor, Kris Persad, 20, placed fourth with “Sunita”. Persad, son of veteran musician Veerendra Persad, rode on stage on a white horse much to the delight of the crowd.

In sixth place was Lalchan “Hunter” Babwah, who sang. “Puncheon”. Defending champion Kenneth Salick did not place among the top six in the competition.

Desmond Allum, the President of the Criminal Bar Association, has written to the Director of Public Prosecutions, Mr Geoffrey A Henderson, calling on him to conduct an investigation into whether former Attorney General John Jeremie attempted to pervert the course of public justice or misbehaved in public office arising out of his reported involvement in the re-purchase of land at Millennium Park owned by Chief Magistrate Sherman Mc Nicolls.

The land transaction was one of the key issues which surrounded complaints against former Chief Justice Satnarine Sharma and attempts to impeach him over allegations that he tried to interfere in criminal proceedings against Prof Vijay Naranysingh and former Prime Minister Basdeo Panday.

Allum’s letter, dated July 18 was released to the press on Friday, the same day it was delivered to the DPP. Also handed to the media was a copy of a similar letter also calling for an investigation from the Association’s Vice-President, Nizam Mohammed, dated April 5, 2007 and addressed to Mr Henderson.

Mr Allum claimed that more than one year later there has been no reply to Mohammed’s letter. Allum wrote to Henderson:

“There is already in existence enough material in the form of witness statements taken in relation to the investigations into the criminal as well as the disciplinary proceedings for us to establish that the Chief Magistrate approached the then Attorney General with two allegations, one about the conduct of Chief Justice Sat Sharma and the other in relation to a suspicious land transaction, at the same time the Attorney General was a key witness against Mr Sharma in the Naraynsingh 137 proceedings.”

Mohammed, in his earlier letter to the DPP, noted that there were enough reports concerning the interaction and communication between Jeremie, Andre Monteil, a senior CLICO executive and the PNM Treasurer, Anthony Fifi, a director of Home Construction Limited and the Chief Magistrate, to warrant a full investigation.

Jeremie’s role in the whole affair, involving attempts to impeach the Chief Justice and the attempt by the Chief Magistrate to re-sell the land he had purchased from Home Construction Ltd at Millennium Park, was heightened by information disclosed in the Mustill Tribunal which was held here in September 2007, Allum stated.

Following the last General Elections, Jeremie was not re-appointed Attorney General. Instead, he received a prized posting as this country’s High Commissioner to London and has already taken up his position there with his family.

Monteil has since retired from CLICO and did not seek renomination as PNM Treasurer at last weekend’s annual PNM convention. Allum’s letter details the chain of events that ended with Mc Nicolls signing a complaint against Sharma on May 5, 2006 reportedly the same day he received a cheque for $390,000 as a deposit towards the purchase of land that Mc Nicolls was trying to sell. With respect to the alleged actions of the Attorney General, Allum’s letter stated: ...

that the Chief Magistrate approached Jeremie with two allegations: one about the conduct of the Chief Justice and the other in relation to a suspicious land transaction. At the time the Attorney General was a key witness against the Chief Justice in the Naraynsingh Section 137 proceedings.

... that despite being a witness against the Chief Justice, the Attorney General began to conduct a private investigation into these allegations in a manner that was not transparent. Thus, he became an active participant in a process calculated to impeach the Chief Justice; ...

that the Attorney General told the Prime Minister about the Chief Justice’s allegations and advised the DPP and Michael Quamina, the Prime Minister’s attorney, about the allegations. He was advised to take a written statement from the Chief Magistrate but did not at the time do so;

... that despite being a witness in the Naraynsingh case against the Chief Justice, the Attorney General apparently did not refer the matter to the Police or the DPP; ...

that no attempt was made to meaningfully investigate or act on the Chief Magistrate’s allegations on the Attorney General’s part, even as he assumed control of these serious allegations — including that senior persons at CLICO had tried to influence the 2006 Panday Integrity trial; ...

that on April 28, 2006 the Attorney General called on a friend Mr Andre Monteil of CLICO, telling him, “clean up your mess”; ...

that the Attorney General encouraged an HCL official, Mr Fifi, to re-purchase a piece of land at Millennium Park from the Chief Magistrate; ...

that the Attorney General forwarded to the Prime Minister a statement signed by the Chief Magistrate, a complaint implicating the Chief Justice, on May 5, 2006, the exact date that the Chief Magistrate received money for the land he sold to HCL; ...

that on the same day, the Attorney General put pressure on the Chief Justice to resign in order to avoid criminal charges arising out of the Chief Magistrate’s allegations.

Allum’s letter quoted excerpts from evidence given at the Mustill Tribunal hearings including Lord Mustill’s expression of disappointment that Mr Jeremie chose not to give evidence before the Mustill Tribunal.

Allum concluded his letter by stating that at no other time in our history was there more need for open transparency in the activities of all public servants and public officials “The matters raised in our correspondence,” Allum told the DPP, “are of serious public importance.

The public has a right to know what action, if any, you will take in the matter.” “You will recall that the Attorney General has stated publicly on several occasions that no one is above the law.

This maxim applies to him,” Mohammed noted in his letter to the DPP.

The call for an investigation into Jeremie’s conduct in the Sharma affair comes seven months after the Mustill Tribunal cleared Sharma of allegations of misconduct levied against him by the Chief Magistrate. During the course of hearings at the Mustill Tribunal in September 2007, Jeremie made one appearance on September 21 before Lord Mustill, Sir Vincent Floissac and Dennis Morrison QC.

Despite serious allegations against him, he later failed to show up at the Winsure Building for cross-examination, with Mustill noting that this fact would be taken into consideration in the drawing up of the tribunal’s final report.

Of Jeremie’s role in the whole affair, the report would later conclude that, “there is evidence, the weight of which we are not in a position to assess, that on May 8, 2006, the Attorney General had attempted to use the Chief Magistrate’s first statement as a means of pressuring the Chief Justice to resign.

“The picture presented to this Tribunal almost defies belief...We have heard allegations against the Attorney General, who could have given oral evidence to rebut them, but did not.”

The report also noted that in the wake of Mc Nicolls’ refusal to testify in the collapsed criminal case against Sharma on March 5, 2007, Mc Nicolls’ flawed legal explanation for his actions “seems to have originated with the Attorney General.”

“The concept of the separation of powers seems to have been ignored...The picture is troubling indeed, both for the Tribunal and for the peoples of Trinidad and Tobago.”

GOVERNMENT yesterday tabled legislation regulating the pensions to be paid to former Presidents, a move which may be viewed by some as laying the groundwork for the possible resignation of President George Maxwell Richards.

The ‘President’s Emoluments (Amendment) Bill 2009’ was quietly laid in the House of Representatives by Leader of Government Business Colm Imbert. The bill seeks to amend the President’s Emoluments Act “to ensure that the pension payable to former holders of the Office of the President is reviewed every six years from the date the holder of the office ceased to be President.” Clause 3 of the bill makes former Presidents “eligible on every sixth anniversary of the date he ceased to be President for a revised pension equivalent to salary payable to the incumbent on that date.”
The review of pensions payable to former presidents may, thus, be revised upwards in an inflationary period, for instance. A 2003 report of the Salary Review Commission raised the President’s salary from $26,000 to $33,000.

The ‘President’s Emoluments (Amendment) Bill 2009’ was not placed on the Order Paper for the Day, but rather the Supplemental Order Paper which is only issued moments before a sitting of Parliament.

Since he returned from vacation on Monday, President George Maxwell Richards has remained silent over calls for him to resign.

The President refused a meeting with members of the Congress of the People (COP) and carried on with routine issues such as the appointment of temporary senators. His explanation of how he came to appoint the members of the last Integrity Commission has failed to allay concerns that he adequately vetted his appointees.

To date the President has failed to respond to any questions sent to him on the issue by Newsday.

FOR the second consecutive day, the gates of Alutrint’s Aluminium Smelter Complex construction site at Union Estate in La Brea were blocked yesterday by angry residents who demanded job opportunites on the project.

The protesting residents alleged that Chinese labourers were being hired for the project over the unemployed locals. A woman complained that she saw foreigners working on the construction site of the smelter plant.

“Look is better I go back home and take care of my children. I do not believe I’m not going to get any work at all. We were told that the residents would be given first preference for jobs on the site, but that is not the case,” the angry woman shouted.

Resident Wendell Superville said that more Chinese labourers were being hired on the project and the ratio of foreign labour to local labour was too wide.

“We could do everything that the Chinese could do and we can do it better.

For every Chinese labourer hired, a local should be hired,” Superville said. Alutrint communications manager Josie-Ann Richards yesterday promised to speak with the residents to see how best the issue could be dealt with.

Magistrates and Criminal Bar express ‘dismay’

The Trinidad and Tobago Association of Magistrates, yesterday registered its “dismay” at what it called “the intemperate assertions ascribed to Justice of Appeal Stanley John.”

The statement was in reply to Justice Stanley John’s strong criticisms of Tunapuna Magistrates Anna Ryan, and Jo-Anne Connor.

In a release yesterday, President of the Magistrates Association, Avason Quinlan, said, “ It is especially unfortunate that Court of Appeal Judge Stanley John would make these assertions at all, and more particularly at a time when integrity in public life is under great scrutiny.

“Justice John, by virtue of his experience, and seniority in the judiciary is well aware of the role, and function of the Court of Appeal, which include deliberating, and making fair comment on issues arising out of matters on appeal.

“The Privy Council exercises the similar role, and function over the Court of Appeal. Newsday understands that Chief Magistrate Sherman Mc Nicolls has called an emergency meeting for Friday afternoon to discuss the issue. Meanwhile, the Head of the Criminal Bar Association, Desmond Allum, yesterday said he was “dismayed” by the statements of Appeal judge, Justice Stanley John.

In his release Allum said, “the Criminal Bar Association viewed the reported statements of Justice of Appeal John with dismay.

Many criminal practitioners have appeared regularly before Her Worship Ms Connor. She operates her court professionally, efficiently, fairly, and with integrity.

Even if the learned Justice found that she had erred in this particular case, his comment that she should resign was entirely out of order.”

So we gone dong Maracas Beach last Tuesday (Divali) and saw 6 big nigga setting up a huge suction/pump generator.

After the machine had been pumping water out for over 2 hours I couldn't help but ask one of the niggas what exactly they were trying to achieve. He explained that they needed to lower the water level because the river continues all the way around to the Main Car Park (by Richard's Shark & Bake) and it causing flooding there.

I then tried to simply explain to him that sucking the water out from one point and pumping it back into the same river (see pics & video below) just doesn't make sense ! Duh ! His reply was, "We just doing what dey tell we to do!"

There's a new twist to the story about the supply of VIP vehicles for two international summits in Port of Spain next year. Now, the Trinidad Express is reporting that the German automaker BMW has denied that it has any deal with Prime Minister Patrick Manning to supply the vehicles for the conference.

Bavarian Motors Ltd, local agents BMW, issued a statement saying it has not had any direct discussion with the government of Trinidad and Tobago or Manning about the supply of the luxury vehicles for the summits.

It denied any connection between a recent visit by its managing director Gordon Borde to Munich, Germany and Prime Minister Patrick Manning’s statement about Government leasing vehicles for next year’s summits, directly from BMW.

Bavarian Motors said it had responded to tenders issued by the National Insurance Property Development Company (Nipdec) to provide vehicles for the summits and “is awaiting a response to its proposals.”

It said Borde attended the annual Importers Conference in Munich from October 28 to November 1 at the invitation of BMW and “had absolutely no knowledge of a visit being paid to Munich and BMW by the Prime Minister.”

It added, “Neither did Mr Borde have any contact with the Prime Minister during his visit to Munich...

There is absolutely no truth whatsoever in any suggestion that Mr Borde accompanied the Honourable Prime Minister on his visit to Munich.” That seems to contradict what Manning told reporters last week at his post cabinet news conference.

Manning announced that he had personally visited the showroom of a large BMW dealer in Germany and sealed the deal under which the Germans would ship the vehicles to Port of Spain for temporary use for both conferences and then take them back.

In dismissing local offers the prime minister said they were too costly. “The local people...put a price on the alternatives that is so high, that you have little alternative but to purchase the cars, which we are determined not to do. We don’t need 200 cars.”

Manning was in Munich from October 30 to 31, to address the “Day of the Americas” conference hosted by the Business Association of Latin America.

Both Borde and Manning were in Germany at the same time.

Manning did not say that he met Borde or any representative of BMW's local agents, Bavaria Motors Ltd. And he didn't say who he met. He told reporters, "I visited the BMW showroom in Munich, we had discussions on the matter and I have to discuss it with our people here.”

Based on Bavaria Motor's Ltd.'s statement and Manning's confirmation that he held talks with BMW, it would seem that the prime minister bypassed the local agent and went directly to the German company's representatives in Munich.

Hunt criticises UNC-built stadia

Government plans to spend some $102 million to refurbish the four stadia which were built under the UNC government for the 2001 Youth World Cup, Sport Minister Gary Hunt stated yesterday.

The stadia were built through the instrumentality of FIFA vice president and Concacaf boss Jack Warner and there was a controversy over the tendering procedures.

"It speaks to the quality of construction," Hunt said, as he noted that the 30-year-old Hasely Crawford Stadium, which was close to the sea, never had a need for that kind of upgrade.

Giving details of the breakdown in cost, Hunt said Government would spend $23.5 million on the Dwight Yorke Stadium in Tobago, $27.5 million on the Larry Gomes in Arima, $22 million on the Ato Boldon in Couva and $29 million on the Manny Ramjohn Stadium in Marabella. He said the Government proposed to put down two artificial fields on the two stadia - Manny Ramjohn and Larry Gomes- which were in high use.

"We would be using the highest specs in the refurbishment and upgrade of the stadia," he said.
Hunt said Government was doing a general refurbishment on the Hasely Crawford Stadium, Shaw Park in Tobago, Woodford Lodge and Saith Park, all in preparation of the Trinidad and Tobago Games next year.

Stating that international athletes such as Usain Bolt would be competing here, Hunt said the Games would be "as close to Grand Prix status as possible". -RT

The Ministry of Health could not help nine-month-old Marissa Ramlal—who died on Tuesday— with funding for a liver transplant because of “budgetary circumstances,” Health Minister Jerry Narace said yesterday.

Narace was speaking at yesterday’s post-cabinet media briefing at the Diplomatic Centre in St Ann’s.

Baby Marissa, who was unable to suckle milk and had been vomiting blood, required $1.8 million to undergo a liver transplant.

Marissa’s belly was also swollen to the size of a football.

But Narace maintained that his Ministry could only operate within budgetary and policy circumstances.

He noted, however, that the ministry gave the maximum possible amount—$60,000—which was “the policy by which we are guided.”

Narace said, “The media will be the first to tell us we must always review our budgets and look at the way we are spending.

“My instructions to the ministry was for us to do the maximum possible to assist the young lady,” Narace added, while offering condolences to baby Marissa’s family.

He said unless the Health Ministry found some financing mechanism it was going to be difficult—but traditionally, people had engaged in different fundraising ventures and that the ministry was more than willing to give the maximum possible amount.

Asked whether the country was equipped to deal with liver transplants and other procedures, Narace said: “These are objectives that we are working towards and there are certain speciality measures/procedures that we are unable to do at this time.

“However, the Government, in trying to create a first world health care system—and we have plans currently to develop two new institutions, one in Port-of-Spain and one in Central Trinidad—we are hoping to acquire that kind of capability as we proceed.”

On the issue of a special fund that would assist families to get specialised care for their children, Narace said an appropriate solution was being sought through the introduction of the National Health System (NHS).

“That NHS is going to be a new system that would allow us to treat with all of these circumstances in the future,” Narace added.

He said the Cabinet had recently approved a health economics unit for the Health Ministry to make appropriate arrangements so that unit would be able to provide the ministry with the cost of a number of services which would commence the NHS system.

The interim measure, however, was the ceiling figure of $60,000, Narace said.

IT IS BECOMING increasingly clear that Prime Minister Patrick Manning is on a journey to leave a legacy not only on the political landscape of Trinidad and Tobago but across CARICOM.
He is already known for toying with political constructs that seek to isolate sub-regions in CARICOM, such as the Manning Initiative which, to this day, does not have a compelling purpose.

But the biggest of Manning's ideas has come in the form of a working paper – not yet government policy – that strives to improve the governance structure of Trinidad and Tobago, perhaps inspired by the 18-18 tie in the 2001 general election.

The proposed reforms of the constitution, however, do not indicate in any way how they would resolve such an occurrence in the future.

The essence of Manning's proposed reforms is to make the executive president the head of both the government and the state, giving what is now an all-powerful prime minister even greater powers of governance and control.

While upgrading the status of the prime minister, the proposed new draft constitution devastates the contribution of other elected members of the House of Representatives, both in terms of quantity and quality in the cabinet.

In fact, according to Manning: "It is proposed that the cabinet would now AID AND ADVISE [my emphasis] the president on the general direction and control of the government. It would comprise the president, vice-president and up to 25 members, of whom not more than six would be appointed from the House of Representatives and three from the Senate. The rest of the ministers would be appointed from outside of the parliament."

Imagine, a leader of a political party in Trinidad and Tobago uses 40 other party members to assist him in securing victory at the polls, but then agrees sufficiently with proposed reforms to bring them to parliament suggesting that at most – not at least – six ministers could be elected Members of Parliament.

On two scores, Prime Minister Manning's motives would have to be questioned: first, no other elected MP has to be a minister; and secondly, the number of ministers elected is restricted to six.

It takes a very special politician, guided by some higher power, to reduce other elected Members of Parliament – from whom he derived his power – to mere statistical objects.

It must be the case that only elected members of the House of Representatives can cast a secret ballot to determine who becomes the executive president.

Under the current constitution, the non-executive president is chosen by the Electoral College, a unicameral body consisting of all of the members of the Senate and the House of Representatives, convened by the Speaker, as chairman, and who has an original vote.

It is particularly striking that only the president and the vice-president are guaranteed membership of Manning's proposed cabinet which has an upper limit of 25 members.

Since the president and vice-president are to be appointed from the House of Representatives, only four other members from the ruling party can become ministers. That makes the proposals even more ludicrous!

Political folly

At the two extremes, ministers appointed from outside of the parliament may make up – at most – 23 out of the possible 25 members of the cabinet, or – at least – 16 out of the possible 25 members.

These ministers would be all appointed by the president who got his power from the elected members of the House of Representatives!

In its current state, the governing party in Trinidad and Tobago must have at least 21 members in the Lower House who, under the proposed reforms, would be restricted to offering only "aid and advice" to the cabinet on the general direction and control of the government – a restriction that is also imposed on the cabinet.

To me, that is political folly in the extreme.

The only reasonable proposal that prevents the new draft constitution from being seen as the making of an elected dictatorship is one for a term limit for the executive president, a maximum of two terms – ten years at most.

Otherwise, the Manning proposals smack of a leader trying to secure ultimate political power, more in search of creating a one-man show than entrenching a participatory democracy that broadens the base of leadership.

Having proposed to emasculate the elected representatives in the Lower House, Manning also wants to see an enlarged and essentially elected Senate for Trinidad and Tobago.

The following proposed reforms may help to restore a sense of balance with respect to those who voted for having some say in the general direction and control of government.

The Senate would comprise 49 – up from 31 – members of which 28 would be elected, and based on recommendations from the political parties following a general election, 18 would be assigned seats on the basis of proportional representation.

The other three senators would be elected by the Tobago House of Assembly.
More questions than answers

The existing nine Independent senators would be no more; yet, it appears that the broad principle – apart from the President becoming more powerful - is to involve more non-political practitioners in the decision-making process.

This identifies a basic inconsistency in the proposed reforms.

Oddly enough, the Cabinet, which has the responsibility only to "aid and advise" the President on the general direction and control of government, would be the least democratic of the institutions of government.

It is widely believed that people who get involved in elective politics do so out of self-interest, and so, it is going to be more than interesting to witness a national debate in Trinidad and Tobago on a proposed constitution that reduces the effective participation of the majority of elected Members of Parliament in running the affairs of government.

Prime Minister Manning is unorthodox, but his desire to change Trinidad and Tobago's constitution to increase the power of the political leader raises more questions than it provides answers.

It is being argued by some commentators that that increased power would come at the expense of the judiciary and the parliament – a frightening prospect for any country!

But perhaps the most frightening aspect of this proposed mischief would be the decimation of the will of the people in the first-past-the-post system used to elect members to the House of Representatives that would have to give way to the will of a political leader, especially in determining the composition of the Cabinet, a body of ministers who traditionally initiate policy and are collectively responsible for the government of the country.

For the sake of the people of the people of Trinidad and Tobago, may it never happen.
The rest of us in the region, especially here in Barbados, should watch the developments closely, because politicians are . . . well, politicians.

PRIME MINISTER Patrick Manning yesterday urged energy companies to show their commitment to saving the environment by looking for alternate sources of fuel to oil and natural gas.

Manning was speaking at the opening of the Association of American Chambers of Commerce in Latin America (AACCLA) annual mid-year meeting, hosted at the Hyatt Regency Trinidad, Port-of-Spain by the local leg of the American Chamber of Commerce (AMCHAM).

The topic of the two-day meeting is energy and the environment. Manning said the topic was timely considering its relevance. “Energy and the environment are closely related as the use of fossil fuels have been linked to present levels of global warming, producing climatic changes and environmental challenges for every country in the world,” he said.

Further exploring the link between the two, he said, the more troubling effects of global warming are experienced by lesser developed countries of the world. “In the Caribbean, we are certainly not one of the world’s major polluters but we have direct experience as islands in the Atlantic, Pacific and Indian oceans are already threatened by rising sea levels, coastal erosion and increasing ferocity of storms, hurricanes and typhoons,” he said.

Manning added that global warming also had links to increasing food prices globally. “Something is fundamentally wrong in the way we have been proceeding in utilising the resources that we have. We, undoubtedly, need to liberalise economies for greater productivity but in the process we are attaining levels of consumption that are clearly not sustainable,” he said.

To combat these problems, he said, there is need for greater energy production, increase emphasis on alternative sources of energy and greater energy efficiency. “It is clear for us in Trinidad and Tobago that no one approach would solve the problems caused by unprecedented energy consumption and its inflationary and environmental consequences. We need a battery of solutions involving all the approaches I have mentioned,” he said.

Mc Leod retires with $4.5M

RETIRED Oilfield Workers Trade Union (OWTU) president general Errol Mc Leod is to receive a retirement package worth $4.5 million for his 21 years of service to one of the country’s richest trade unions.

An OWTU source told Newsday yesterday that the contents of the separation package include a house to be built at a cost of $2 million on a piece of land owned by Mc Leod in Aripero, a new X5 BMW SUV worth $750,000, guaranteed car insurance for the next five years plus a $1.5 million annuity.

According to reports, the OWTU general council approved Mc Leod’s retirement package during a meeting at the union’s headquarters at Paramount Building, Circular Road, San Fernando. The meeting was chaired by Mc Leod.

Mc Leod was celebrated last night by members of the union at a ceremony at the Palms Club, San Fernando.

When contacted for comment, Mc Leod said: “I don’t know what my separation package is worth and even if I knew I wouldn’t disclose.” When given a breakdown of the package, Mc Leod said: “I never knew I was valued so highly by the union.”

McLeod worked as a refinery operator at State-owned oil company Petrotrin and became the union’s second vice president, labour relations in 1975 before rising to the position of president general. He retired from Petrotrin about three years.

OWTU sources said the May 31general council meeting was attended by an estimated 35 delegates. Four of them abstained from the vote on the package for Mc Leod and one voted against the multi-million dollar payout. Sources said the delegates voted in favour of the package without discussing the proposal with their respective branches.

Some delegates felt it was exorbitant compared to the retirement package for his late predecessor George Weekes. “A committee was formed and we all went back to our branch unions where we discussed the matter. Weekes had to give up the deed for a piece of land he inherited in Petit Bourg. The union took that money to help purchase the house in Cocoyea, San Fernando that was given to him. His package was never exorbitant like this,” said a source.

Mc Leod had announced that he was giving up his position as the leader of the union at the OWTU’s annual general meeting last July and was passing the baton over to first vice president Ancel Roget.

With crime at its highest ever, Trevor Paul has quit as Commissioner of Police breaking the year-long extension he had to continue to serve as head of the Police Service.

Paul advised the members of his executive of his decision during a meeting at the Police Administration Building in Port-of-Spain on Tuesday.

Sources said Paul felt he had done all that he could to lead the Police Service in its fight against crime, which has risen to unprecedented levels with murders standing at 243 for this year to date.

Paul is expected to leave on Monday and he has already begun to pack his books and personal documents and mementos from his service of over 40 years.

“Monday might be my last day in office. I have done my part and it is time to move on,” he told his executive of Assistant Commissioners of Police (ACPs) on Tuesday.

When contacted yesterday, Paul would only say, “When I am leaving office you will know, I will tell you myself.”

Paul had been asked to stay on for an additional year as the top cop although his official retirement date was November 9, 2007.

Sources said Paul’s decision to break his extension before November is expected to put additional pressure on the Government to get debate moving in Parliament on the appointment of a new Commissioner of Police (CoP).

Well at last! This total waste of a Police Officer will be shipping out. His tenure will be remembered as one in which the CoP was the biggest failure in this country.

But really all that focker wanted was to get he pension. Now he goin to live like some big pappy at the expense of the citizens of T&T.

National Security Minister Martin Joseph yesterday apologised for his now infamous pronunciation of the word "arrests" as "arrestes" during last week's post-Cabinet news conference.

He did so during yesterday's post-Cabinet news conference at Whitehall, Port of Spain, one week after making the verbal blunder, while responding to questions on new anti-crime measures that the Government expects will result in an improvement in its war on crime.

"I know it's too late now. I certainly, I certainly apologise," Joseph said.

He quipped that the mispronunciation was an attempt on his part to help boost the Police Service's low detection rate.

Global food prices are expected to remain high over the next decade, spelling hardship for millions of the world's poorest, the United Nations' Food and Agriculture Organisation and the Organisation for Economic Co-operation and Development said in a report last week.

Mr Nath said India had already allowed some exports to Sierra Leone and would consider other exemptions for Africa. "We will have some carve-out to African countries depending on our own current production," he said.

He did not give details but there is speculation that India might eventually export about 2m tonnes of rice to the least developed African countries as well as some neighbouring nations, including Bangladesh, Nepal and Bhutan.

The move fits with India's growing diplomatic efforts to woo African nations and counter China's rising influence in the resource-rich continent.

India's economy continues to grow strongly, reaching a rate of 9 per cent in the last fiscal year, according to government figures released on Friday.

The new report predicted growth of 8.5 per cent this year but the rising cost of fuel has contributed to a sharp jump in inflation. In the 12 months ended May 17, it reached 8.1 per cent, a three and a half year high and well above the central bank's target of less than 5.5 per cent.

Mr Nath said the price of imported cooking oil and lentils had more than doubled "not because of India-supply stress but international supply-side stress".

REIGNING Miss World, Zi Lin Zhang, is convinced that a visit to T&T was just what she needed to gather her thoughts, in the wake of the devastation caused to her native China by a massive earthquake.

She said her decision to travel to T&T, while her countrymen were still coming to terms with the disaster, was a necessary sacrifice at this time.

Zhang believed that she could do more for the people of China by creating greater awareness of the effects of the natural disaster, while the search for survivors continues and the death toll rises.

Authorities in China have mounted a massive relief and rescue operations.

Meanwhile, international aid agencies remain alert, monitoring the situation, to lend assistance to those in need.

Using her limited command of the English language, Zhang said she hoped that her visit would brighten her spirits and consequently allow her to do more for the people of China.

“As you know, my country has had a terrible earthquake. I was sad and everything. I hope I can come here to be more happy and do more for my country.

“All of us (are) working hard. We are raising funds for the earthquake. I don’t know how to do more, but I would try my best.”

During a media conference in the VIP Lounge at Piarco International Airport, Julia Morley, chairman of the Miss World Organisation, who accompanied Zhang on this trip, defended her decision to fly to T&T.

She said thousands of Chinese troops had been deployed on the grounds and had the reigning Miss World gone back home, “all she could have done was stand and stare.”

Morley disclosed that there were discussions on whether Zhang should return to China at this time, but it was decided that she could do more “useful things here,” rather than stand and stare.

“Unless you are a qualified person working, digging people out you are only able to stand and stare.

“Is it not better to come and do something useful here?” she asked.

Morley made it clear that on their return to China, a big fund-raising exercise would take place in that country.

Zhang arrived at Piarco International Airport on Friday, almost an hour past her scheduled arrival which was caused by a flight delay.

Her visit to T&T was on the invitation of the National Aids Co-ordinating Council (NACC) for this evening’s 19th National Aids Candlelight Memorial in the borough of Chaguanas.

Zhang and her entourage were received by former Miss World, Giselle La Ronde-West; former Miss T&T/World delegate, Valene Maharaj; Angela Lee Loy, chairman of the NACC, Andy Fearon, acting head of the NACC; and Peter Elias, national director of the Pageant Company of T&T.

Also present were reigning Miss T&T/World representative Gabrielle Walcott; Miss T&T/Universe delegate Anya Ayoung-Chee; and Adrian Raymond, of the Pageant Company.
Morley said: “We work very hard around the world to do the best we can to bring awareness to the problem (HIV/Aids) that we all face.”

Le Gendre: Moonilal insulting students

EDUCATION Minister Esther Le Gendre is disputing UNC-A Oropouche East MP Dr Roodal Moonilal’s claim that the nation’s schools are a breeding ground for the recruitment of young criminals to gangs.

And a lot of criminality also took place on school compounds, Moonilal accused.

During debate on proposed legislation to rectify the pensions of certain senior officers in the Teaching Service, he called on the Government to take urgent steps to protect teachers while they were on the job.

It was a task that needed political will, said Moonilal, as he urged Le Gendre to heed his call.
In winding up debate on the Bill, which was passed without amendment, Le Gendre took issue with Moonilal.

She said it was an “insult” to the over 300,000 students on roll at over 700 schools for Moonilal to say that the nation’s schools were a breeding ground for the making of criminals.

Schools may have “a few recalcitrant elements” but that did not make them a breeding ground for criminal activity, Le Gendre argued.

She stressed that the statement was unbecoming of the Moonilal.

He had claimed the Education Ministry was not operating smoothly because deans and heads of departments were complaining that despite their seniority in the system some teachers were earning more than them.

Le Gendre explained that a number of allowances had been approved for the deans and heads of department; the accounts department was preparing the pay sheets and the grousing officers would get retroactive payments to rectify their salaries.

The UNC had boasted of their rapid-pace school building programme, but all the schools built between 1996 and 2001 were now “giving trouble.”

She said she had never seen buildings deteriorate so fast and they were turning out to be the “bane” of the ministry.

In respect of repairs to schools, she said doing this maintenance work during vacation periods have proven to be unsatisfactory and now work would take place also during the school term.

Cumuto Manzanilla MP Harry Partap was told that a new Biche High School was in the planning stage.

Designs had been received and work would soon start on the new school.

IN ONE fell swoop National Security Minister Martin Joseph swept all blame for there being 79,989 unsolved serious crimes, including murder, kidnapping, rape and robbery with aggravation, in the six-year period 2002-2007 on to the broad shoulders of Police Commissioner Trevor Paul.

Joseph stressed Paul was the man to call to account, when responding to UNC-A Chief Whip Ramesh Lawrence Maharaj crime motion in the Lower House on Friday.

Reached yesterday for his reaction to Joseph saying as the head of the Police Service he was the State’s front man for the curbing of runaway crime, Paul said he did not hear Joseph’s response, so was not prepared to comment on the say-so of the Sunday Guardian.

Paul recently got a six-month extension of his employment contract and Joseph told the House on Friday that soon MPs would be debating the appointment of a new commissioner.

In a motion on the adjournment of the House, Maharaj said in the period the National Security Ministry had spent over $15 billion, yet had failed to keep crime under control.

Citizens did not feel safe to venture out of their houses; the issue had gone beyond the pale of political rivalry and the fact of the matter was a solution had to be found.

Pitiful rate

As an MP, said Maharaj, he had seen first-hand the suffering, the fear and the trauma that families endured at the hands of criminals.

Maharaj said Prime Minister Patrick Manning had assured Senator Joseph was his best Cabinet Minister.

If that was so, he added, then something must be wrong with Manning’s judgment.

He had got the crime statistics from 2002-2007 from the Police Service’s Crime and Problem Analysis (CAPA) department and they were frightening.

He proceeded to read them out in all their detail, emphasising the pitiful rate at which serious crimes were being solved.

They showed that over the period murders had risen by 40 per cent; the detection rates was less than ten per cent and the conviction rate of those charged was less than one per cent.
Maharaj said he did not want Joseph to tell the nation about future plans, or about the activities of police units like SAUTT or the IATF.

The nation wanted to feel safe. They wanted assurances from the Minister that they could be secure in their homes and on the streets, in the day, and particularly at nights, Maharaj stressed.
To his mind, the solution in the first instance was to have officers posted throughout the streets of T&T on a 24-hour basis, even if it meant re-routing traffic police and court officers to crime duties.

Police also needed motivation to rise to the occasion, Maharaj added.

“Forget the politics, tell the people what you are going to do to prevent crime,” Maharaj urged Joseph. “We cannot go on like this... time is running out.”

Joseph responded saying that since Police Service reform legislation had come into force the Police Commissioner was no longer a toothless bulldog.

He had the power now to promote and fire up to Assistant Commissioner.

His job as Minister, said Joseph, was to provide the financial and human resources to the Commissioner and leave the job of solving crime to him.

Any interference in the performance of the Commissioner’s duties by the Executive would be seen as politicising of the Police Service, Joseph said.

Yes, there was a shortage of officers, but recruitment of 500 new officers a year was the plan, with the recruits all having at least five “O” level passes and being subjected to a polygraph test.
The CAPA department provided “real time” crime statistics, which was essential to curbing crime, he added.

Joseph assured once the Police Commissioner made optimum use of his resources the incidence of serious crime would be reduced.

INSISTING that Prime Minister Patrick Manning has done no wrong, newly appointed chairman of the Diego Martin Central constituency Dr Joe Laquis says he will support the PM for the leadership post in the People’s National Movement’s party election.

A PNMite for 33 years, Laquis said it would be idiotic for anyone to oppose Manning, because the PNM was closely knit and united, which no one could penetrate or destroy.

Laquis was commenting about former Diego Martin Central MP Kenneth Valley, who last month had urged sacked trade and industry minister Dr Keith Rowley to press on with plans to fight Manning for leadership of the PNM.

Manning’s post of political leader is up for contest as well as other PNM executives at the PNM’s June 28, 29 convention.

Rowley fought Manning for the post in a bitter fight in 1996, which Rowley lost, having mustered only 40 per cent of the votes cast.

“We don’t disagree and go against one another in this party. This is how PNM politics works. Everybody would surround and protect Manning at the end of the day. You just wait and see,” Laquis added.

Laquis said when one looked at Manning’s performance over the last six-and-a-half years much had been accomplished for T&T.

Laquis said if one had to choose between Manning and Rowley, the favoured candidate would likely be Manning because of his leadership qualities.

“There is no reason to remove Manning.... while at the same time there is no clear indication that he should go.”

Getting feedback from the ground level, Laquis said he was optimistic that when the final vote was counted, Manning would make a clean sweep.

“He would net everything in the bag.”

Boynes gets $20M tax break

FORMER Minister of Sport and Toco/Manzanilla MP Roger Boynes and his brother Ronald Boynes, chairman of the Sangre Grande Regional Corporation chairman, have enjoyed a $20 million tax break on their Salybia Resort and Spa.

This was revealed by Legal Notice 54 in the Trinidad and Tobago Gazette of April 10. The document cited an order, made under the Tourism Development Act, for a tax-break in the form of a capital allowance on the brothers’ investment of $20,566,731 on the resort as an approved tourism project. The order also exempts the resort from paying any tax on its gains or profits for five years.

A TRACTOR yesterday bulldozed five acres of agricultural land in Spring Village, Valsayn destroying fields of produce including ochro, pepper, dasheen bush and coconuts, leaving farmers very upset since the produce was ripe for harvest.

The angry farmers told this reporter that when they asked the driver of the tractor on whose instruction he was acting, to destroy the crops, he (the driver) said he was authorised by the Housing Development Corporation (HDC).

However, several efforts by Newsday to verify this with HDC yesterday proved futile with several calls to the corporation’s corporate communications department, going unanswered.

The farmers said that in the midst of spiralling food prices and a public plea by Consumer and Legal Affairs Minister Peter Taylor for increased local farming to reduce food costs, they cannot understand why anyone would want to destroy their gardens. The farmers added that for the past few years, they have applied for regularised land tenures but this has not been done. They are appealing to Agriculture Minister Arnold Piggott to intervene on their behalf and have them regularised so they could legitimately plant their crops on State lands.

According to brothers Vijay and Sonnylal Jagdeo, who have earned their living from working the land for the past 16 years, workers claiming to be contracted by the HDC were instructed to clear the land. Vijay said the destruction of the gardens came without warning and the five farmers were left with no choice but to watch their only source of income being destroyed. “I begged them to at least leave something behind...but they just kept going,” Vijay said.

“Government talking about agriculture but they are doing something else and now with this (the gardens) gone, we do not know where to turn. We do not know what to do,” Sonnylal cried.

National Food Crop Farmers Association’s Education and Research Officer Norris Deonarine, who represented the farmers, called on the Agriculture Ministry to give priority to regularisation of land tenures to enable farmers to take control of their land and develop it efficiently to ensure ample local food crop production.

GOVERNMENT spent approximately $48,000 out of a total of $197,000 through the Ministry of Community Development, Culture and Gender Affairs to help “keep the peace” in Laventille in 2006.

These figures were contained in a document which Community Development, Culture and Gender Affairs Minister Marlene McDonald brought to the Senate on Tuesday to respond to a question posed to her two months ago by Opposition Senator Wade Mark to list all of the organisations that received funding/grants and/or financial support from her ministry from the period January 2, 2002 to December 31, 2007.

Under the section of the document entitled “Community enhancement and safety programme,” for 2006, it said the ministry allocated $12,000 to the Laventille Peace Initiative Against Crime $12,000 to stage a “Caravan for Peace in Laventille.” Another $14,500 was allocated to this group for a “caravan for peace” in Arima in the same year. The Executive Council for Laventille received $8,746 for a peace caravan in Morvant. The Laventille United Safety and Enhancement Group received $7,000 from the ministry to host a cultural exchange and the Beetham Gardens Police Youth Club was allocated $7,000 to host a Christmas Lunch and Award ceremony.

At Tuesday’s sitting of the Upper House, Senate President Danny Montano did not allow McDonald to read from the document. He apologised to her and the Senate for not directing that the answer to Mark’s question be written and not oral.

$5.7M for National Security consultants

MINISTER of National Security, Martin Joseph, said since 2001 to present his Ministry has spent $5.7 million on consultants to train police officers, soldiers and forensic scientists.

He gave the details in reply to a question by Tabaquite MP Ramesh Maharaj on Friday in the House of Representatives. Joseph said $1.637 million was spent on consultants to train the TT Police Service, some $3.835 million for the Defence Force, and $228,000 at the Forensic Science Centre (FSC).

In 2003 a consultant (Clive Thomas) earned $74,000 to train FSC staff in analysis of seized drug material, examination of stolen motor vehicles/serial registration-number restoration, and arson investigation.

In 2005 a consultant (Ernest Massiah) earned $154,000 for training FSC staff in firearm and tool- mark examination.

Elsewhere some $3.835 million was spent training TTDF staff in 2007 to 2008 at the University of the West Indies in Leadership and Management from certificate to MSc level.

Some $1.637 million was spent on consultants to train officers of TT Police Service. This included $361,000 spent in 2001; some $195,000 in 2002; $422,000 in 2003; $308,000 in 2004, $96,000 in 2005, $38,400 in 2006, and $216,000 in 2007.

The police trainers included Franklyn Dolly who taught conflict resolution and anger management, Alma Thompson teaching telephone etiquette and Patrick Zoe teaching forensic investigation on insurance arson fraud.

Further, in 2007 Dana Seetahal who is still an Independent Senator, was paid $174,000 to do Advanced Prosecutors’ Training.

Like is one thing these conts doh understand.

MOTORISTS stuck in heavy traffic along the Beetham Highway looked on in horror and amazement as teams of young men looted a stalled delivery truck, stealing tens of thousands of dollars worth of rice and flour yesterday evening.

The motorists using cellular phones, called in the police and a motorcycle officer who was further up the highway checking to see if motorists were using the shoulder of the highway, responded to an All Points Bulletin and went to the stalled truck.

According to police reports, at about 5.30 pm, the truck stalled in traffic along the east-bound lane of the highway near the dump when from out of nowhere, dozens of young men, some of them teenagers, attacked the driver.

As motorists watched in amazement, the men began removing bales of rice and flour, running across the highway and handing the precious commodity to other persons who in turn disappeared in Beetham Estate, while the looters returned to the stalled truck.

When the motorcycle officer arrived on the scene, the looters disappeared by running through Beetham Estate while the officer radioed for backup. His firearm drawn, the officer stood guard until heavily armed officers from the Besson Street Police Station arrived.

They guarded the truck for several hours until a wrecker arrived to tow it away. Up to late yesterday no arrests were made and investigations are continuing.

Officers said only the flour and sugar was targetted by the looters who ignored other items including sugar and soft drinks.

Recently, the price of flour and rice have skyrocketed, with local distributors blaming world prices for the increased costs.

Motorists told Newsday that it was high time Government forget about fancy anti-crime measures and implement tried and trusted measures including more foot and mobile patrols especially along the dangerous Beetham Highway where anyone could be a target of bandits.

This is nothing new.

These fockin animalistic niggerites of the Beetham that the PNM does starve, chew dem up and then vomit dem back on society have been doin this ah long time now.

The fockers robbing people on the higway on ah regular basis and you could never see the Police around. At one time they were throwing stones on people windshields and when dey stop dey rob dem. What exactly IS the rule on the use of laptops? And if there is one prohibiting its use, then that needs to be addressed.

Winston Dookeran should have resigned, not Gillian Lucky, according to COP member Gary Griffith.
In a statement issued yesterday, Griffith severely criticised Dookeran and Selby Wilson for "resorting to mudslinging" and to "attacking" Lucky for resigning.
"They (Wilson and Dookeran) were previous NAR supporters, then they became UNC supporters, then COP supporters, without even a sabbatical being taken from political parties altogether, holding posts such as Central Bank Governor, but they have the audacity to attack the character and intent for Gillian Lucky resigning, simply because it is not in their best interest," he said.
Griffith said the NAR "over the hill boys", such as Wilson and Joseph Toney, who were "roped in to strangle the COP" by Dookeran, have also been openly questioning the moral authority of Lucky, himself and others have to challenged the direction and productivity of the COP, simply because they (Lucky and others) have refused to attend two meetings.
"Gillian Lucky probably became frustrated because the COP was not properly serving the nation and going nowhere fast, with Winston Dookeran conveniently circling himself among a few clueless blind loyalist supporters, whose priority was grinding their axes on the PNM and UNC rather than trying to serve the people of Trinidad and Tobago," he said.
He said the party was doomed to fail if Dookeran continued as leader.

PM’s son applied for apartment
HDC says application was made two years ago. “He meets the criteria”

Brian Manning, son of Prime Minister Patrick Manning, applied two years ago for an apartment in the Housing Development Authority’s upscale Fidelis Heights development in St Augustine, HDC managing director Noel Garcia confirmed yesterday.

The Fidelis Heights development is one of HDC’s pricier projects, located at Gordon Street and Santa Margarita corner in the upscale eastern suburb—opposite the Hugh Wooding Law School.
Garcia spoke on the situation, after queries on the matter to Planning and Housing Minister Emily Dick-Forde at yesterday’s weekly post-Cabinet media briefing.
Dick-Forde said she was not aware of an allocation for Manning.

However, Garcia confirmed Manning’s application was made to HDC two years ago “like that of any normal citizen of T&T.”
“Mr Manning (Brian) is currently going through the assessment process,” Garcia said.
“As far as I am aware no allocation has been made for Fidelis Heights yet, so if there is any question whether he has been actually allocated an apartment there, it is very much a premature question as far as I’m concerned.”

Garcia said Manning’s application came through normal channels—via an application form submitted to HDC and entered into the Authority’s database. “He’s made an application and it is being assessed like any other citizen— he’s one of thousands who apply to HDC.
“Quite a number of people applied for Fidelis Heights units and this development will be allocated shortly.”

Garcia said the Government had taken a decision not to subsidise this particular development.
It is being sold at market rates in HDC’s thrust to expand and attract an open market clientele.
The development is therefore not part of HDC’s provision of subsidised housing for low-income earners. HDC’s promotion puts the prices for units at Fidelis Heights in a range between $566,000 and $877,000.

Female co-applicant
Guardian checks confirmed that Manning’s application was made jointly, in name with another—female—applicant whose workplace is listed as a Federation Park research institute.

Manning, 33, was a business analyst with the Inter-American Development Bank and a business development analyst with Neal and Massy.

In 2006, he became head of PNM’s Web site committee.

Speaking then, Manning said he was a businessman and did not intend to follow his father into politics. He said he was concentrating on projects.

Last year, young Manning was the centre of some controversy when he submitted a proposal to the Basketball Federation for establishment of a semi-professional basketball league.
Estimates were that it would cost taxpayers $3 million. The plan had not got off the ground to date, sports officials said.

Yesterday, calculations revealed that in order to afford a mortgage of one of the Fidelis Heights’ apartments, a prospective homeowner may have to have a salary range of around $30,000 monthly.

The development which cost more than $140 million was completed recently. It was in construction over the past four years. Sod-turning for the development took place in 2004.
The development comprises 180 units in its Phase 1 and Phase 2 plan.
The apartments involve three-bedroom units and three-bedroom plus basement townhouses.
Former housing minister Keith Rowley—now Trade Minister—was not in office yesterday.

At the sod-turning for the Fidelis development, Rowley had noted that low cost-housing was a thing of the past due to high-priced land and property value.

Panday calls for disclosure
Yesterday, Opposition Leader Basdeo Panday called for full disclosure on the matter.
“We have heard that HDC houses are allocated on a lottery system,” he said.
“In this case if the houses are for sale and young Manning can afford it, it will be interesting to know where he got the money from and if he is getting an allocation ahead of anyone else.
“We’d like to know how many other people have applied and how many have been refused for this particular development,” Panday said.

While many Standard Five students were relieved after writing the Secondary Entrance Assessment exam yesterday, one 11-year-old was greeted with the news that her father had been murdered during a family row.

Sean Joel Pollard, also called Kuta, 33, a URP labourer of Jojo Lane, El Socorro Road in San Juan, died on arrival at the Eric Williams Medical Sciences Complex in Mt Hope.
Relatives said he was stabbed to death by a male relative, who remained on the run from police up to late yesterday.

Pollard’s grieving common-law wife Natalie Nurse, also a URP employee, said, “Is better he had stabbed me and kill me instead. He (Pollard) was a good one and (name called) know that.”
She explained that an argument started between she and the suspect earlier in the day and when it got heated Pollard intervened.

She explained that after he was stabbed Pollard cried “boy we so good and this is what you go do?” According to relatives, Pollard was stabbed once in the left side of his abdomen and took his last breath at the emergency ramp of the Mt Hope Hospital. The stabbing took place just after midday.

Police said the arrest of a 20-year-old San Juan man was imminent.

All I have to say is this is the first time I agree with a nigger, and I find the relevant person(s) can heed to her wish:

Changes coming, says senior officer

Sweeping changes in the system of reporting crimes, identification of police officers and a step up on the prosecution of people committing praedial larceny were some of the changes announced for a revamping of the Police Service by senior officers on Thursday night .
At a meeting held with residents in the Forres Park area, Deputy Commissioner of Police Glen Roach told villagers: "Officers will be wearing name tags during the execution of warrants or while making enquiries."

Roach said it will not be necessary in the future to make reports at police stations in the area where a crime is committed.
"You will now be able to make them at any station and we will ensure that the report is forwarded to the appropriate station," Roach said.
Roach led a team of senior officers to interface with residents on the increase in crime in the area.

The meeting was attended by the parliamentary representative for the area, Ramesh Lawrence Maharaj, and representatives from the Couva/Tabaquite/Talparo Regional Corporation.
Among those who made presentations to police officers was a woman who requested anonymity. She told the officers that burglars entered her home, tied her up and took away several valuable items.

After listening to the reports, the officers advised the villagers that the police were aware of the problems they encountered. Roach advised them to "work along with the police and give them the necessary support".

The villagers were also told that there will be an increase in the number of police officers on patrol throughout the country. Officers in police cars have been asked to make periodic stops to talk to villagers.

"They will not be driving through the area alone.
"We have asked them to stop and have friendly chats with villagers," a senior officer at the meeting said.

He said the administration was looking into the establishment of "rural constables" to operate within the community.

5) Revamp the whole service get rid of the shit units - CSU, CID, AKS whatever

Joseph: Guyana massacre senseless

GOVERNMENT yesterday condemned the killing of 12 persons, including three police officers, in Guyana’s gold-mining town, Bartica, on Sunday, the second massacre within a month which has sparked fears of a breakdown in law and order in the country.

Eight persons were wounded in the shooting spree which spread from a police station to the streets.

National Security Minister Martin Joseph yesterday disclosed that he had made efforts to speak with Guyana’s Home Affairs Minister Clement Rohee “to determine what assistance, if any, may be needed at this time.”

Joseph, chairman of a Caricom committee of national security ministers, said he was appalled at “the senseless killings and loss of lives through this dastardly act by cold-blooded killers” and expressed concern that police officers were among the dead.

Trinidad and Tobago’s High Consul to Guyana, Ernie Ross, yesterday described the massacre as a brutal act of terrorism but said Guyana has not asked any country for help to apprehend the killers or restore calm to Bartica.

Regarded as one of Guyana’s prime tourism sites, Bartica is located 80 miles southwest of Georgetown on the banks of the Essequibo River on lands covering an area of 83,000 square miles and is a gateway to the country’s dense hinterland.

Ross said no Trinidad and Tobago nationals were among those killed or injured in Bartica. He said Guyana’s President Bharrat Jagdeo was overseas at the time of the attack on a “confidential mission” concerning his country’s security challenges and was expected to return home last night.

Warring gangs to sign peace treaty

IN an effort to curb the escalating violence in Laventille, two of the area's warring factions are said to be preparing to sign a peace treaty tomorrow.

A community activist yesterday called the Express to indicate that the peace accord is to be signed between the Picton and John John gangs under the watchful eyes of the police.
But Commissioner of Police Trevor Paul said yesterday he had no knowledge of any such agreement. However, Paul said if such an agreement were to be made, the police would be ready.

Over the past week, there has been a buzz of activity in Laventille, culminating in the eight-hour lockdown of an area known as Beverly Hills, all in the wake of an upsurge of violence which followed the killing of notorious gang leader Sheldon "Crock" Scott on Carnival Sunday.
On Saturday, 16-year-old Kevin Lewis was killed near Pump Trace and on Sunday night Curt Lester was shot dead in a track off Picton Road. Two houses in Picton were also firebombed that night.

Several peace accords have been signed among the warring factions in the Laventille area before, but none of them have ever held up as the killings and gang-related violence have continued.

What the muddercunt fucking shitness and assholeness is this?

LAWYERS for former Prime Minister Basdeo Panday want Magistrate Ejenny Espinet to step down from hearing his bribery case.

Ramesh Lawrence Maharaj SC, lead counsel for Panday and his wife Oma, submitted yesterday in the Port-of-Spain First Magistrates’ Court that Espinet was a trustee of the Morris Marshall Development Foundation in Laventille.

Maharaj said the Marshall Foundation promotes the activities of the ruling People’s National Movement (PNM) which is opposed to Panday’s United National Congress (UNC).

He said there could be a public perception that the magistrate was promoting the aims of the Foundation. Maharaj said he had evidence that persons who went to the Foundation for assistance were told they must carry a PNM party card. He said when Panday’s case went before the magistrate, she had a duty to tell the lawyers that she was a trustee of the Foundation.

The Tabaquite MP said apart from Espinet being a trustee, there were other names on the list such as John Jeremie and Martin Joseph.

“This is a very sensitive matter,” Maharaj added. “I am serving notice that if you decide against me after hearing my submissions, I will not call evidence, but I would test it in the High Court.”

Maharaj added, “The politics in the country are very much alive, the country is divided politically. Here is a magistrate who is involved in a Foundation started by a former PNM Minister.”

Maharaj said there was the likelihood of apparent bias and cited the case of Panday v Virgil in which the Leader of the Opposition was charged with failing to declare a London bank account to the Integrity Commission.

He also cited the case of Pinochet in which Lord Hoffmann was accused of apparent bias because of his wife’s links to Amnesty International. After hearing the submissions, Espinet said she would give her decision on February 19.

But Panday and his wife were excused because they are expected to be in London for his Privy Council appeal as to whether he should be retried on the integrity charges.

Ishwar Galbaransingh, Carlos John, and the Pandays are charged with a series of offences which allege that Galbaransingh and John gave Panday £25,000 as a bribe to favour Galbaransingh’s Northern Construction Limited in the tendering process for Piarco Construction Package 3 back in December 1998.

Ejenny is a fockin PNM stooge. Sitting and hearing this matter without telling the fockin people that you and your PNM assholes were in the same organisation.

UNC Alliance MPs Ramesh Lawrence Maharaj and Jack Warner yesterday promised Beverly Hills residents that their fears over crime in Laventille will be taken up with the Government.

They also promised to help revitalise Laventille through the introduction of football clinics and classes for women to acquire skills.

Warner and Maharaj met a handful of Beverly Hills residents who spoke about searches by the police and army in their community, which had been prompted by recent violence. “I will send some football coaches and donate the footballs starting from today,” Warner told the few Beverly Hills residents.

Tabaquite MP Ramesh Lawrence Maharaj defended the visit saying it was not meant to score political points.

“We believe that where a fear or insecurity exists and whenever the need arises, we will go in and help,”said Maharaj

He said letters will be sent on the residents behalf to Prime Minister Patrick Manning, Minister of National Security Martin Joseph and the Police Commissioner Trevor Paul. Maharaj said the police, especially those trained in community policing, should maintain a round-the-clock presence in Laventille to ease residents fears and to guide the troubled youths.

He said criminal gangs are going to become uncontrollable because they extort money from residents.

“This is a time when the Inter Religious Organisation and every stakeholder should understand that if they do not intervene, the country will have no rule of law, no accountability, and the criminals will be in control of every sector”, he predicted.

One vocal woman said she wanted more social programmes for the Beverly Hills community.

“I have two left foot, I cannot play football, but what I want, Mr Warner, is to buy a kiln machine so that I could teach the women in Beverly Hills how to make ceramics.”

She said she planned to approach her MP Marlene Mc Donald for help to set up programmes in Beverly Hills.

I dunno why Jack and Ramesh feel they could help these niggas.

Understand one thing fellas, these niggas will rather fock themselves in dey bottom wid ah young balisier rather than give political support to you boys.

Ghetto godfather

For seven years, Sudhir Venkatesh studied the workings of a Chicago street gang. His new book explains why gangs flourish--and how to get rid of them

In 1989, a University of Chicago graduate student named Sudhir Venkatesh decided to leave his cocoon-like campus, and find out what life was like in his city's notorious public housing projects. So he wandered into the decrepit Lake Park projects in Chicago's Oakland neighborhood, introduced himself to a group of teenagers shooting dice, whipped out a clipboard, and asked them this question: "How does it feel to be black and poor? Very bad, somewhat bad, neither bad nor good, somewhat good, very good?"

"You got to be f-cking kidding me," the ringleader said. And the whole dumbstruck group convulsed with laughter.

Hearing how ridiculous his own question sounded, Venkatesh realized then and there that he was wasting his time. The residents of this squalid building were living lives completely alien to his middle-class upbringing. He wasn't going to get inside their heads with patronizing multiple-choice questions.

But foolish as he felt, Venkatesh caught a break that day, one that eventually set him on a path to a rock-star reputation within sociology, and a professorship in the Ivy Leagues.

The toughs Venkatesh stumbled on were low-level foot soldiers with the Black Kings, an enormous regional outfit whose Lake Park operations were controlled by a formidable gangland general named J.T.

Against all odds, Venkatesh struck up an instant bond with the man. Unlike just about everyone else who lived at Lake Park, J.T. had been to college, and had even studied sociology in preparation for a short-lived career in the legitimate business world.

A narcissist, J.T. imagined his life to be worthy of biography, and invited Venkatesh into his inner circle as a sort of court scribe. For the next seven years, Venkatesh would become eyewitness to the inner workings of gang life. His remarkable account of those years -- contained in a newly released book, Gang Leader for a Day: A rogue sociologist takes to the streets-- is required reading for anyone who wants to understand why gangs continue to thrive among the West's underclass.

The first thing one notices about the world Venkatesh describes is this:

There are no fathers. Everyone at Lake Park -- even J.T., who commands 200 gangsters and, in a good year, makes six figures from crack-dealing -- lives with their momma.

The young men don't dream of settling down with a family. Rather, they seek to emulate the polygamous J.T., who uses his drug proceeds to lodge various girlfriends in separate apartments. With no father figures to guide them, these men internalize the juvenile conception of manhood peddled by rap videos, and fritter away their adolescent years pursuing it through streetcorner posturing and brawling.

The nature of the local economy is the second thing that stands out: Except for the corner stores (which are run by Arabs), there is little legitimate free-market activity. Virtually all of the money coming in to Lake Park comes from two sources: government welfare and drugs. The few people who apply actual market-able job skills within the community -- such as the mechanic "C-Note," who gets his name because he has "a hundred ways to make a hundred dollars" -- are so rare as to be minor celebrities.

As a result, criminality is normalized: The idea of studying hard, going to college and getting a respectable job -- the formula for success applied by waves of European and Asian immigrants to North American since the late 19th century -- is dismissed as a white man's fantasy.
Gang life is at the centre of all these pathologies.

But as Venkatesh explains, the local residents' attitude toward the Black Kings is actually quite conflicted. Because violence attracts police, and police scare away customers, J.T. has an economic interest in keeping life in the projects peaceful. For a small cut of the action, his henchmen provide a security detail for the local crack dens, and protection for prostitutes. They also drive sick residents to the hospital, organize basketball games, and even stage get-out-the-vote drives on behalf of the local black political machine. There is plenty of violence in Gang Leader for a Day. But it is not random. Like all petty tyrants, J.T. understands that his legitimacy rests on providing some semblance of order.

The portrait that emerges from this book therefore complicates the simple black-and-white way we normally think of the gang problem. Yes, gangs act as a criminal evil that act in opposition to the law-and-order culture that pervades mainstream society.

But in very poor areas that are bereft of the basic sociological building blocks of middle-class society -- stable families, legitimate employment, job skills, respect for education -- an established gang can, in some instances, take over some of the functions normally served by police, employers, and even social workers.

At the same time, Gang Leader for a Day implicitly suggests a strategy for tackling this underlying subculture: overhauling the drug laws and welfare programs that serve as its two-pronged economic power source.

As Canadian gang expert Michael C. Chettleburgh wrote in a June, 2007, National Post op-ed, our criminal prohibition of recreational drugs permits gangs to capture the massive economic premium associated with illegal enterprise. By treating drug use as what it truly is --a health problem instead of a criminal-justice problem -- we would force gangs to fall back onto far less lucrative activities, and thereby discourage membership.

At the same time, implementing a draconian welfare reform of the type the United States enacted under Bill Clinton could serve to eliminate the state's role in subsidizing a ghetto culture in which permanent unemployment is seen as a viable lifestyle choice.

Ultimately, all social reform begins with responsible people making individual decisions: No government policy can force people, of whatever skin col-our, to live their lives in a responsible way. But we can do a better job at setting up the right incentives, so that teenagers and young adults find themselves more inspired by Venkatesh than the gang leader he's written about.

Rowley cleared

TRADE Minister Dr Keith Rowley has been cleared by the Integrity Commission of any wrongdoing. But the Minister is not leaving it there, as he intends to seek aggravated and exemplary damages against the Commission for what he called the “gross damage to my personal character and public reputation.”

By a letter dated February 1, Martin Farrell, Registrar of the Integrity Commission, wrote to Rowley about the investigation which they had been conducting since 2004 concerning the Landate housing project in Tobago, and the award of the contract for the Customs and Excise building in Port-of-Spain. Farrell wrote, “As a result of further investigations into this matter, the Commission is now of the view that there is no longer any basis for suspecting that you may have conducted yourself in a manner that was in breach of your duties under the Act (Integrity in Public Life Act 2000), and I have been directed to advise the Director of Public Prosecutions of this decision.” Farrell ended his letter, “This investigation is now at an end and the Commission thanks you for your cooperation.”

But in a statement issued yesterday, the Diego Martin West MP pointed out that in October 2004, Ganga Singh, the then MP for Caroni East, using the protection of parliamentary privilege, “dramatically made the most scandalous and unfounded allegations against me resulting in a public Commission of Inquiry, with which he failed to cooperate and in which I was exonerated from any unlawful conduct of any nature.”

Rowley said that notwithstanding this, the Integrity Commission embarked on its own separate inquiry. The Minister said he was shocked to see in the media that he was the subject of a police investigation by way of a submission of rumours to the DPP.

Rowley said the baseless allegations have caused gross damage to his personal character and public reputation and additionally have caused his family, particularly his wife, whose private sector project, was the subject of the initial slander, inestimable discomfiture and unwarranted embarrassment.”

Although the Commission has admitted that Rowley has been cleared, the Minister is still seeking a declaration that it acted in bad faith and/or was motivated by ulterior motives and/or was reckless.

Rowley said he was seeking aggravated and exemplary damages.

The case comes up for hearing on March 3 before Madame Justice Maureen Rajnauth-Lee in the Port-of-Spain High Court.

In November 2004, the Integrity Commission embarked on an investigation in respect to unspecified allegations regarding the siphoning of materials from the Scarborough Hospital site to a development project at Mason Hall, Tobago.

The development at Mason Hall, owned by Rowley’s wife Sharon, has been referred to as the Landate project.

Opposition Leader Basdeo Panday is calling for a public enquiry into Government's acquisition of its first national security blimp, which cost $12.6 million but was not suitable for the country's weather conditions.

"Who recommended it? You can't come now and tell us the atmosphere was bad. What happen? Somebody change the wind?" Panday said yesterday

He said there should be a public enquiry to investigate the Government's acquisition of the other blimp ,which along with the first have cost the State $67.1 million over the past three years.

"There was a massive corruption and bribery in the purchase of those blimps and we must demand a public enquiry," Panday said. at the UNC-A national congress meeting at the party's Rienzi Complex headquarters in Couva.

Panday said that the acquisition of the blimps must be examined in the same way that the Piarco International Airport terminal building project had been.

The Commission of Enquiry into that project led to charges being laid against former national security minister Russell Huggins and former finance minister Brian Kuei Tung along with several other people.

Their cases are still pending.

His comments came three days after National Security Minister Martin Joseph, disclosed in the Parliament exactly how much money the Government spent on the blimps.

Joseph defended the acquisition saying that they were part of an overall law enforcement strategy and provided vital intelligence for crime fighting.

Joseph said the Government sold the first blimp, the Aeros 40B SkyDragon, for its original $15.75 million price tag and after spending an additional $7.2 million to repair it.

So the real fockin price of this piece of shit is really almost 23 million. Will any fockin body in dey right mind buy something and spend half of the cost to repair it. Doesnt make fockin sense to me. To PNMites maybe!

The Government then leased the Skyship 600 at a cost of $4,785,590 for the period November 24, 2005, to mid-May 2006 and then purchased it at a price of $15,750,000, in June 2006.

The Skyship 600 is the only airship currently in operation and costs an average of $1.417 million a month or $17.01 million annually while an additional $26.9 million has been spent to repair and maintain it.

Opposition chief whip Ramesh Lawrence Maharaj says the Integrity Commission is investigating a top Government minister who allegedly has a $49 million (US$8 million) bank account in the United States.

The Tabaquite MP was addressing the UNC’s national congress at Rienzi Complex in Couva yesterday, when he made the disclosure.

He said the minister had already been questioned by police, and the Prime Minister Patrick was aware of the situation.

Maharaj claimed that the minister had failed to disclose the information to the Integrity Commission and had gone to the US to change the paper trail, but failed and came back the night before Parliament opened.

Maharaj said the Opposition was going all out to make the Government account on this and other issues of corruption.

The UNC-Alliance MP said several members of Government boards had indicated that they were going to resign from these boards, because they were not prepared to be investigated by the Integrity Commission.

Maharaj said many board members had been involved in influence peddling.

He said some companies involved had no tendering procedures, and there were several allegations of major Government corruption.

Maharaj said the Government’s mega security projects were only avenues for PNM bigwigs to siphon State funds through kickbacks.

He said the blimp, patrol boats and helicopters had all failed to detect any crime, even though millions of dollars had been spent.

Martin Joseph defends $67m spent on blimps as Opposition charges corruption...

National Security Minister Martin Joseph admitted yesterday that the very first blimp which this Government had purchased at a cost $12.6 million was not suitable for this country's weather conditions.

In addition, Joseph said $7,056,000 was spent to maintain and repair this non functioning blimp-Aeros 40B SkyDragon-that was acquired on December 20, 2004.

This was over a six-month period at $1,176,000 a month.

Joseph disclosed these figures at yesterday's Parliament sitting at the Red House, Port of Spain, in response to a question on the Order Paper from Princes Town North MP Subhas Panday.

Joseph said Government acquired and leased three aerial surveillance platforms between 2004 and 2006.

According to Joseph, the Aeros 40B SkyDragon, "was later found to be unsuited for the local atmospheric conditions" and as a result a decision was taken to lease a new blimp - the Skyship 600.

The SkyShip 600 was leased at a cost of $4,785,590 for the period November 24, 2005, to mid-May 2006 and repairs and maintenance cost were part of the lease.

Joseph said in 2006 the Government sold the first blimp at its initial cost and decided to purchase the Skyship 600 at a price of $15,750,000.

The Skyship 600 was purchased in June 2006 and according to Joseph it is "the only airship currently in operation".

Joseph said the average cost of maintaining the Skyship 600 is $1,417,000 a month, which amounts to $17,010,000 annually.

Since it was purchased, approximately $26,929,000 has been spent to repair and maintain this blimp.

According to the figures provided by Joseph, this means that approximately $67,120,590 has been spent on blimps over the past three years. Government was able to recoup $12.6 million spent on the purchase of the first blimb which it sold.

Joseph described the blimp as an operation tool in the law enforcement regime and not an independent asset and it is part of a holistic information and intelligence programme that involves all the arms of law enforcement agencies in the country.

"This intelligence gathering capability has proven to be of tremendous use as an investigative aid and as a resource in crime management,'' Joseph said.

"While extensive detail relating to its operations cannot be disclosed for reasons of national security, I would like to reassure my honourable colleagues that the airship remains a valuable asset and that its contribution toward helping to alleviate the current crime situation cannot be underestimated," Joseph continued.

He was then pressed by Tabaquite MP Ramesh Lawrence Maharaj and Panday (S) as to what sort of crimes and the number of criminal activities the blimp helped to solve.

Joseph reiterated that the specific number of crimes the blimp has aided cannot be calculated as it is all part of a holistic effort of law enforcement agencies.

In defence of the blimp, Joseph pointed out that this technology is increasingly being used by a number of countries to curtail various types of crimes.

He said the United States secret service used it during the 1994 World Cup, it was also used by the New York police department for counter terrorism activities as well as in Greece for the 2004 Olympics.

Joseph said last year the Venezuelan Government purchased three blimps in an effort to curtail criminal activities in that country as it has the highest death rate from firearms with some 34.3 deaths per 100,000 according to the United Nations.

What fockin amount of maoney this fockin PNM has to spend for zero return on investment.

For Joseph to 'answer' as he did (because he really didn't answer at all) is fockin downright insulting to the intelligence.

“It has proven to be of tremendous use as an investigative (tool) and resource in crime management,” he says. Oh fock?

How exactly has the blimp done so? It is a mudder cont flying antenna, nothing more, and may be equipped with directional sound amplifiers to listen in on conversations on the ground. However, it is doubtful that it ever heard any conversations of value beyond "Ay, allyuh see the blimp up dere?"

And using the fact that other countries have also purchased blimps in the past is hardly an answer to the question 'what has the blimp done for us?' -

Blimps have been used for things like the World Cup for one simple reason: they can stay aloft and almost stationary for extended periods of time, unlike fixed or rotary winged aircraft, and thus don't require constant takeoffs and landings to refuel, but these events have been of limited duration and for finite geography, which is a very different application than the one that cacahole is 'defending'.

A major research institution has announced the discovery of the heaviest element yet know to science - "PNMtium." Prime Minister Patrick Manning said yesterday that he was very pleased with the performance of the protective services.

"There have been no real incidents and from what I understand is that police and the protective services are on a zero tolerance programme."

Manning made the comment yesterday while visiting the San Fernando East Constituency office.
Manning was not accompanied by his wife, Senator Hazel Manning.

He said, "she is playing mas in Port of Spain with Tribe and tomorrow (Tuesday) I will be at the Prime Minister's house. I have a lot of work to do and this will give me an opportunity to get through most of my paperwork."

He said that he was very impressed with the work that the CEPEP carnival crew is doing in San Fernando, "I couldn't believe my eyes when I came down Coffee Street."

Mayor Kenneth Ferguson was also in loud praise for the work that the workers.

"Hear nah man, before the masqueraders drop something on the ground the group was there to pick it up and put it in garbage bags," he said.

He said he was very happy with the carnival programme and with the behaviour of the revellers.

Kidnapped woman released

KIDNAP victim Zalina Mohammed has been released. Police said Mohammed was released after part of a $1million ransom was reportedly paid to her abductors.

Mohammed, 32, was kidnapped from her home on Main Road, Orange Valley around 8.30 am by two menlast week Thursday .

She and her family operate a wholesale liquor store downstairs her home.

Mohammed was released near Sum Sum Hill, Claxton Bay around 2 am yesterday.

A report said two men pulled up at the businessplace and took out two empty cases of beer. The men claimed they wanted to purchase two cases of the product.

Mohammed then told a male employee to assist the men. One of the kidnappers pulled out a gun and bundled Mohammed in a Mazda 323 vehicle.

Sources said yesterday Mohammed was in good health. She was shaken by the ordeal, however. (AD)

Carnival violence leaves five dead

The Carnival has been marred with violence, as five men, among them the brother of attorney Wayne Sturge, were killed in separate incidents during last Friday’s Soca Monarch competition and J’Ouvert morning.

Their deaths have pushed the year’s murder toll to 50.

Several others were stabbed and robbed during the Carnival celebrations.

It was only last week that Police Commissioner Trevor Paul announced that no one would spoil the mas, while Tourism Minister Joseph Ross said tourists had nothing to fear.

Nicholas Sturge died at Port-of-Spain General Hospital on Sunday, after he was stabbed during Friday’s Soca Monarch at Queen’s Park Oval.

Sturge, 25, of Greenhill Village in Diego Martin, died after suffering from multiple stab wounds to his back, detectives said.

A report said Sturge was at the competition around 5 am on Saturday when he was accosted by two men who attempted to rob him.

Sturge struggled with the men and was stabbed in the back. The men disappeared in the crowd.
Sturge was taken to hospital, but succumbed to his injuries.

Three other patrons were stabbed at the Oval and taken to hospital for treatment.

Up to late yesterday evening, one partygoer was listed in critical condition. The other two patrons were treated and discharged.

Wayne Sturge Snr, father of the deceased, complained in a telephone interview about the lack of proper treatment at the hospital and from the police.

He said nurses ignored his son when he complained of breathing problems.

“My son cried in pain and we (relatives) told the nurses, who only said he saw a doctor half-an-hour ago.”

“I don’t want money; it can’t bring back my son. I want justice for them doctors to face the penalty. They are lapsing.” .

The irate father said when he spoke to a police officer, he said he could not do anything, because of the lack of evidence.

Former Laventille Executive Council member Sheldon “Croc” Scott, of Picton Road, was killed on Sunday night at Fatima Trace in Laventille.

Police said Scott, described as “Most Wanted and notorious,” died around 9 pm.

A report said residents heard several loud explosions. On checking, Scott’s body was found in a pool of blood.

Macdonald Padmore, public relations officer of the Laventille Executive Council, said men were killing for fame or a stupid cause.

Padmore said peace talks would be held after Carnival.

Wayne Sherry, 40, of Prizgar Lands in Laventille, was found dead on Sunday night on Sixth Street, Beetham Gardens.

A police report said Sherry left home with a female companion to find transport for her around 10.15 pm.

Beetham residents reportedly heard several loud explosions and called the police.

When officers of the Inter-Agency Task Force responded, they found Sherry’s body on the road.
His body bore multiple gunshot wounds.

In light of recent developments, the Vision 2020 Secretariat has had to revise the original Vision 2020 to incorporate some goals that it feels will be most likely to be achieved.

Black men missing

There is no longer a need for dire predictions, hand-wringing, or apprehension about losing a generation of Black boys. It is too late.

In education, employment, economics, incarceration, health, housing, and parenting, we have lost a generation of young Black men.

The question that remains is will we lose the next two or three generations, or possibly every generation of Black boys hereafter to the streets, negative media, gangs, drugs, poor education, unemployment, father absence, crime, violence and death.

Most young Black men in the United States don't graduate from high school. Only 35 percent of Black male students graduated from high school in Chicago and only 26 percent in New York City, according to a 2006 report by The Schott Foundation for Public Education. Only a few Black boys who finish high school actually attend college, and of those few Black boys who enter college, nationally, only 22 percent of them finish.

Young Black male students have the worst grades, the lowest test scores, and the highest dropout rates of all students in the country.

When these young Black men don't succeed in school, they are much more likely to succeed in the nation's criminal justice and penitentiary system. And it was discovered recently that even when a young Black man graduates from a US college, there is a good chance that he is from Africa, the Caribbean or Europe, and not the United States.

Black men in prison in America have become as American as apple pie. There are more Black men in prisons and jails in the United States (about 1.1 million) than there are Black men incarcerated in the rest of the world combined.

This criminalisation process now starts in elementary schools with Black male children as young as six and seven years old being arrested in staggering numbers according to a 2005 report, Education on Lockdown by the Advancement Project.

The rest of the world is watching and following the lead of America. Other countries including England, Canada, Jamaica, Brazil and South Africa are adopting American social policies that encourage the incarceration and destruction of young Black men. This is leading to a worldwide catastrophe. But still, there is no adequate response from the American or global Black community.

Worst of all is the passivity, neglect and disengagement of the Black community concerning the future of our Black boys.

We do little while the future lives of Black boys are being destroyed in record numbers. The schools that Black boys attend prepare them with skills that will make them obsolete before, and if, they graduate. In a strange and perverse way, the Black community, itself, has started to wage a kind of war against young Black men and has become part of this destructive process.

Who are young Black women going to marry? Who is going to build and maintain the economies of Black communities? Who is going to anchor strong families in the Black community? Who will young Black boys emulate as they grow into men? Where is the outrage of the Black community at the destruction of its Black boys? Where are the plans and the supportive actions to change this? Is this the beginning of the end of the Black people in America?

The list of those who have failed young Black men includes our government, our foundations, our schools, our media, our Black churches, our Black leaders, and even our parents. Ironically, experts say that the solutions to the problems of young Black men are simple and relatively inexpensive, but they may not be easy, practical or popular.

It is not that we lack solutions as much as it is that we lack the will to implement these solutions to save Black boys. Car dealers plan to shut down PoS

Foreign-used car dealers intend to shut down Port of Spain next Friday, president of the Pre-owned Car Dealers Association Inshan Ishamel said yesterday, after a three-and-a-half-hour protest in front of the Ministry of Trade and Industry on Independence Square, Port of Spain, yielded no response from Minister Keith Rowley.

Speaking to the Express after the protest yesterday afternoon, Ishmael said, "The battle has just begun. That is why next Friday will be Black Friday. We will be bringing all of our vehicles with D plates and blocking the streets of Port of Spain. Port of Spain is going to remember us."

The car dealers, their families and employees descended upon the capital early yesterday, waving placards out their car windows, honking horns and blinking headlights in protest of the ministry 's decision to put a hold on the issuing of licences to them.

Protesting outside of the ministry's Nicholas Towers office, Ishmael said: "We are asking you, Mr Rowley, with all due respect, to change your mind because we are not backing down."

The dealers called on the minister to issue the licences so they could feed their families and pay their employees.

"We want we licences, right now, we need we money, right now."

Other protesters who were unable to get parking spaces at the side of the road circled Independence Square with signs stuck to their car windows, doors and car hoods. Many of the placards questioned what would happen to the price of vehicles when there was no more competition for the new car dealers.

Ishmael was adamant that even if they do not get the licences, they would still import the cars.
"This registered system was only started two years ago and they haven't even given it a chance, but if this system is stopped we will go back to the old system. We will go online and order the cars just like we used to do before they started registering us and still bring them in because this industry serves the poor people," he said.

"If Mr Rowley feels he is going to push, I am going to push harder."

At one point it seemed like the car dealers and the police would clash, as the group of protesters started crossing the street back and forth, standing in front of cars and even sitting in front of cars, hindering the flow of traffic along the road and the pavement on Independence Square.
Ishmael and the other protesters were then confronted by the lawmen, who told them they had no permission to gather on the pavement of the Brian Lara Promenade and they should disperse.

In a release issued late Thursday, the ministry said it had already issued 2,900 licences to the 352 registered used car dealers as of January 23, 2008, and additional licences had been temporarily suspended pending the completion of a current review of the quota system.

POLICE Commissioner Trevor Paul yesterday issued a stern warning to members of the public arrested during Carnival Monday and Tuesday, that they will be kept in custody until they appear in court on Ash Wednesday.

In the past, persons arrested in Port-of-Spain on Carnival Monday appeared before a magistrate during a special sitting but as a strategy to deter persons from committing crimes, a decision was taken to keep arrested persons in custody in the mandatory 48-hour period which the police are allowed.

Paul made the statements during a press briefing with Chief of Defence Staff, Brigadier Edmund Dillon, Director of the Special Anti-Crime Unit of Trinidad and Tobago (SAUTT) Brigadier Peter Joseph, and Comptroller of Customs and Excise Fitzroy John at the Ministry of National Security, Port-of-Spain yesterday.

Paul, who was the first to address members of the media, said, “I have also given strict instructions to police officers to deal aggressively with those who choose to indulge in criminal activities, and moreso, to confront law enforcement as they commit their criminal acts.”

“It must be understood that any such confrontation will be met with the degree of force that is deemed necessary,” said a tough talking Paul.

He said 4,000 police officers will be utilised during the celebrations with support from the Defence Force which will have soldiers on the ground on mobile patrols and on reserve at camp. The Commissioner did not say where the 4,000 officers will come from since the Police Service was up to yesterday operating with a strength of close to 2,500 officers.

Newsday learnt that the Commissioner has recalled officers on leave to report for duty to augment the strength of the service for Carnival.

J’ouvert will begin at 4 am on Carnival Monday. Police officers are threatening to “sick out” in protest over the non-payment of overtime owed to them since February last year. Sources revealed that the Commissioner has not given any indication when the overtime will be paid.

In terms of security, Paul said officers assisted by soldiers will also focus on the properties of those who may be away from their homes participating in the Carnival, either as masqueraders or spectators, ensuring that their properties are not the targets of criminals. He also said closed circuit television cameras will be used in Port-of-Spain and outlying areas.

The Commissioner was given the assurance yesterday by Brigadiers Dillon and Joseph that the police will get the necessary support in an attempt to make Carnival crime free and safe.

John said the coastal areas will be properly manned by customs officers and they will engage in joint patrols with the police in hot spots where smuggling takes place.

Yesterday, in an earlier press briefing at the Police Administration Building, Deputy Police Commissioner Gilbert Reyes said 2,000 police officers and 500 soldiers will be deployed in Port- of-Spain to ensure that Carnival is safe. With respect to threats that police officers owed overtime will proceed on a “sick out”, DCP Reyes said as far as he is aware, officers will not be proceeding in any sick out or protest action.

Ship carrying refugees was Trinidad-bound

Trinidad was the destination of a ship carrying starving refugees from Africa, that was found adrift off the coast of Brazil.

On Wednesday immigration officials said the emigrants were being lured by Trinidad's booming economy and the promise of jobs.

A news report out of Rio De Janeiro stated that a barge drifting in the Atlantic Ocean on Tuesday was carrying 13 people, who had spent 17 days at sea making a trip across the Atlantic Ocean of almost 2,000 miles to get to Trinidad. The refugees were said to be showing signs or malnutrition and dehydration, the report stated.

They were taken into custody and joined more than 80 other people from 11 African States who were arrested in the Brazilian city of Sao Paolo.

Local immigration officers said the refugees were arriving in growing numbers along Trinidad's unsecured south coast, brought in by smugglers coming from Guyana and Venezuela.

A Ghanian man was held in Moruga last Friday in a police roadblock and went to court yesterday, charged with illegally entering Trinidad. He was denied bail and taken to prison.

Three other men believed to be from Ghana, and who arrived by fishing boat in Moruga, are being sought by police, who said that many of the Africans trying to get to Trinidad were from Sierra Leone, Nigeria.

Last month, six Vietnamese nationals were held in South Trinidad, and held for deportation.

A source in the Immigration Department said that emigrants were coming to work in construction jobs, knowing their ethnicity would make them anonymous. And they were being forced to make the Atlantic trip because of tough new visa requirements to get into Europe and strict enforcement of laws against illegal immigration. There is no visa requirement to land in Brazil.

With refugees coming in at Erin, Quinam, Moruga and Point Fortin, there are only three police investigators attached to the south Immigration Department to prosecute cases, the Express was told.

Griffith challenges Dookeran's Leadership

Past concerns that Congress of the People (COP) political leader Winston Dookeran had been selected, and not elected, into the leadership of the United National Congress (UNC) more than two years ago have now followed him into the party he founded, even though it gained 148,000 votes in the last general election.

Dookeran's leadership style is being directly challenged by one of the COP's frontline members and Port of Spain North/St Ann's West candidate in the last general election, Gary Griffith.

Griffith had written a letter to Dookeran that strongly criticised the COP political leader's leadership style about two weeks ago.

"Winston Dookeran has become a law unto himself," Griffith said in an interview with the Express this weekend.

"Our political leader was selected rather than elected and we need to have some electoral process to have the full support of the 148,000. I don't think we can get an extra vote with Winston Dookeran as the political leader," Griffith also said.

He said the COP's constitution only provided for an interim executive until the holding of its internal elections which are done sometime in the middle of this year.

"It was decided upon that because of the general election that was upcoming, that executive will operate in that manner until the internal election will be due within a year's time of the appointment of the interim executive, which will be in the middle of this year," Griffith said

Contacted by the Express, Dookeran said while he would not comment on any specific aspect of Griffith's claims, all of the COP's members were moving forward towards the goal of attaining a victory in Local Government elections due by July of this year.

"And we are proceeding very well and there are lots of people who are working and working at all levels, from the bottom level to the top level of the COP all over the country," Dookeran said.

Dookeran won the UNC political leadership unopposed while he belonged to the party during its internal election in October, 2005 but never become Opposition Leader.

This, among other factors, led to his forming the COP on the mantra of what he calls "new politics."

He said the COP is continuing to build on its founding principles of integrity in all our institutions, transcending all divisions in the society and advocating serious social reform.

"We are working to keep that alive and I am doing my part to ensure that happens," Dookeran said.

In response to Dookeran's comments, Griffith said, "For him to say that we are moving forward and everything is working well, that is a figment of his imagination."

Griffith said that Dookeran, as the COP political leader, has set up several parallel groups that are taking their instructions from him without any input from the executive.

Griffith told the Express the COP faithful must shift its focus to the party's internal elections which are due at around the same time as the Local Government elections.

Griffith said that while he had informed Dookeran that he is no longer willing to chair the COP national security council until its internal elections are held, no one should interpret his actions as indication that the COP is falling apart.

GOVERNMENT is revising the “archaic” Table of Precedence which comprises the order of protocol of the nation’s highest office holders. A complaint from the Inter-Religious Organisation (IRO) prompted the Government to revise the list.

This was revealed yesterday by Foreign Affairs Minister Paula Gopee- Scoon who told Newsday that since she assumed office three months ago, she looked at the Table of Precedence and found that it was deficient.

“It is a very sensitive issue and we took the decision to have a review by March, and this review may involve Cabinet, but by then we will be announcing to the public the re-branding of foreign policies,” said Gopee-Scoon.

She added that the issue was very high on the agenda and admitted that the Order of Precedence which is almost 20-years old needs to be reviewed.

The Table of Precedence which is not an official list but was adapted from the 1966 official list, names the President as the country’s highest office holder, with the Prime Minister second, and the Chief Justice third.

Sources revealed that some members of the IRO had expressed concern over the Table of Precedence listing the Archbishop of Trinidad and Tobago, as being the country’s eighth highest holder of office, followed by the Bishop of Trinidad and Tobago in ninth position, with the Chief Representative of the Hindu Religion being the tenth highest holder of office.

The Chief Representative of the Muslim Religion holds the 11th spot and the Chief Representative of the Council of Evangelical Churches holds the 12th position.

In a 2005 survey, it was determined that Roman Catholics make up 26 percent of the population, while the Hindus consist of 22 percent, Anglicans are eight percent, Muslims are six percent, Seventh Day Adventists with four percent, and Baptists, Pentecostals, Presbyterians and other religions making up the rest of the population.

Opposition Leader Basdeo Panday holds the 13th highest office in the country.

The Table of Precedence was first adapted by the Governor Generals, but later used by the Ministry of Foreign Affairs.

GEORGETOWN, Guyana: Gunmen stormed into a coastal village early yesterday and shot dead 11 people, President Bharrat Jagdeo said, in escalating violence blamed on a gang leader who has threatened widespread attacks.

The killings in Lusignan were the deadliest massacre in this small South American nation in more than 30 years, and came hours after gunmen attacked police headquarters in the capital, firing indiscriminately and wounding two guards.

Three children were among the dead in Lusignan, located seven miles east of Georgetown, the capital.

“This could not have been done by human beings, but rather by animals,” Jagdeo said as he prepared for meetings with security officials and the military.

He said he would go to the village to meet with grieving relatives later in the day.

On Wednesday night, suspected gang members killed a Guyanese soldier during a gunbattle in Buxton, a village two miles from Lusignan. Police and government officials say they suspect a gang led by Rondell Rawlins, a former Guyanese soldier, is behind the violence.

Rawlins has accused security forces of kidnapping his pregnant 18-year-old girlfriend days ago and police said he threatened to carry out attacks until she is found. Police stated they are probing the woman's disappearance. Rawlins is accused of being a crime boss since 2002, and blamed him for the April 2006 slaying of Agriculture Minister Satyadeo Sawh – a murder that authorities said was aimed at destabilising this former Dutch and British colony.

Reacting to the massacre in Guyana, Congress of the People (COP) in a release said that the growing trend of marauding gangs who now operate throughout the Caribbean with impunity must be reversed. COP urged regional governments, including the TT Government to offer logistical and technical support. “It may be time that the Regional Task Force be placed on standby,” COP said.

Independent Senator Gail Merhair said “the Regional Security Services should be strengthened to give quick and aggressive assistance to one another, especially in times of crisis.”

MICHAEL Osuna, known in the calypso world as Sugar Aloes, made a triumphant return to Skinner Park, San Fernando, yesterday as a contestant in the semi-final round of the National Calypso Monarch competition.

And the unapologetic People's National Movement (PNM) supporter was seen as he was never seen before-dressed in a t-shirt belonging to the United National Congress-Alliance (UNC-A), a silver wig, red beret and yellow flower garland.

After a one-year absence from competition, as a result of illness, Aloes received a rousing welcome from the large audience at the event billed as "The Battle at High Noon".

In an interview with the Express following his performance of "Reflections", Aloes said he wanted to send a message to his fellow competitors.

"I want to tell them to look out because I am back," Aloes said.

About his performance, Aloes said he felt confident and was glad to be back in active competition.

"I found the crowd to be very receptive. It seems like they were more happy that I was back than I was."

Armed with a mirror with a photograph of UNC-A leader Basdeo Panday, Aloes waded into the Opposition Leader for comments he made to his dejected supporters shortly after it was announced that the PNM was victorious at the polls on November 5. Panday called on those who voted in favour of the PNM and the Congress of the People (COP) parties to look at themselves in the mirror and bow their heads in shame every time a criminal act is perpetrated against one of the nation's citizens.

'Five suspects are made to lie on the ground for a police search after being held for attacking a group of newspaper photographers....'

NEWSPAPER photographers who covered the Chutney Soca Monarch Finals at Skinner Park, San Fernando, were attacked by a group of bandits outside the venue early yesterday morning.

Newsday photographer Anil Rampersad suffered an injury to his back, while Express photographer Dave Persad was allegedly slapped in the face and hit with a bottle on the head. Photographers Trevor Hackett (Express) and Rishi Ragoonath (Guardian) escaped unhurt.

Five suspects have been detained in connection with the incident which took place as the photographers were headed back to their respective vehicles parked on the “B” ground, Skinner Park, the designated parking area for the media workers on the night.

Rampersad said they were denied parking inside the venue and were shuttled into Skinner Park. However, after the event a shuttle service was unavailable.

The photographers were attacked at about 3.45 am as they were walking along the Rienzi/Kirton Highway, Cross Crossing, near Skinner Park. A gang of about eight men rained bottles on them when they reacted to their alleged attempts to rob them. Rampersad was struck in the back with a bottle as he tried to run for cover.

Plain clothes police officers on their way out of Skinner Park were alerted to the incident.

Five suspects were held and taken to San Fernando CID where up to late yesterday evening they were still detained.

The injured photographers were forced to seek medical attention at the Princes Town District Health Facility after waiting several hours at the San Fernando General Hospital without being attended to. Rampersad yesterday blamed organisers of the annual chutney event for the unfortunate incident.

He explained: “If only the media were shown some more respect with parking arrangements this would not have happened.”

Investigations are continuing.

“The fundamental human rights of people must be preserved. While you are trying to hang people, don’t do it at the expense of the fundamental human rights enshrined in the Constitution of Trinidad and Tobago.”

On Monday September 21, 1998, during a House of Representatives’ debate on the now-lapsed Constitution (Amendment) Bill (Number 2) 1998 which effects the Privy Council’s “Pratt and Morgan” ruling to ban execution more than five years after sentencing, Manning had said citizens need protection from State abuses.

At that time he told the Lower House: “The Inter-American Commission on Human Rights and the United Nations Committee on Human Rights were set up to protect victims from state abuse . . . Therefore, it is not necessarily the criminals, it is not just persons who find themselves on the wrong side of the law, it is also honest and upright citizens whose only responsibility and desire is to go about their own business without interfering with the fundamental rights of others.

It is the PNM’s view that when one is dealing with abuses by a state, it is an unequal match and, therefore, there is an advantage.

“Some additional protection is necessary by way of international oversight by some body or bodies who are outside of the political arm of any particular state. It is most important...

“We are saying that the status of any decision or the result of the deliberations of those two bodies must be enshrined in the law of Trinidad and Tobago.

“We are not saying that those two bodies are superior courts of record in this country. We are not saying that at all. In no country is it that way. We are saying that those bodies have only a persuasive responsibility and jurisdiction in determining what happens here.”

Support for end to $2 billion subsidy

THERE IS strong support for Trade Minister Dr Keith Rowley’s suggestion that Government review the annual $2 billion vehicle fuel price subsidy.

University of the West Indies (UWI) lecturer Gregory McGuire said yesterday that he is happy that a Minister of Government has finally come forward and made the statement on the record.

McGuire, an Energy Economics lecturer, said of the huge subsidy, “It is wastage of our natural resource assets, artificially keeping the cost of vehicle maintenance down. Once oil went beyond US$50 a barrel, it ought to have been capped.”

He also lamented that people do not recognise the extent of the subsidy they have been getting.

Some well known businessmen also agreed that the time has come for Government to review its position on the costly endeavour.

One of the entrepreneurs, said, “This $2 billion a year subsidy is horrendously too much of a brunt for tax-payers to bear. It is time that people in this country pay the full price for their fuel consumption, as the financial bonanza TT is currently experiencing will come to an end. When the money runs out, they will still have to pay the full price.” The businessman said Government should have started reducing the subsidy to a zero rating over a three or five year period and continue tallying what it would have subsidised on an annual basis to place the money in the Heritage and Stabilisation Fund. At September 2007 the HSF stood at $11 billion.

Public really paying for Paul?

POLICE COMMISSIONER Trevor Paul is right. He has every reason to be upset with members of the public who have condemned his decision to enjoy an Old Year’s night party with his wife.
After all, Commissioner Paul, is a true, true Trini and if he chooses to put on a Tribe costume and join Minister Martin Joseph, and take a lil wine—or even a big one—on Carnival Monday and Tuesday, why should anyone be upset?

The only thing we have to ensure is that the Commissioner wines like a Trini, or else everyone should be disappointed.

In this day and age, a lil wine, even if it is on Old Year’s night, could go a long, long way in easing the tension and stress to which some of us are daily exposed.

And believe me, some of the people who are in positions like Commissioner Paul, could do with something that allows them to free up and come down to the level from which you and I operate.
It is almost as if the moment they are given an elite position where bodyguards and other security personnel becomes part of their world, they are closed off from the rest of the society.
In other words, they become disconnected from the citizenry.

It took the Security minister all of four years to realise that “some of” the Government’s crime initiatives were not working.

Imagine murders, rapes and kidnappings rapidly climbing day by day and the minister not aware that crime initiatives were not working. Hello!

Was he in T&T during those four years? I wonder.

But back to Paul.

The Commissioner, as I said before is absolutely within his rights to feel aggrieved by the personal attacks.

After all, he was scheduled to go on pre-retirement leave last year and it was only because we begged him to remain that he is still there.

So don’t you expect him to be in a vacation mode?

The way things are going with the criminal element, if I were the Commish, you could be sure the minute my time was up, I would be dusting my pants and riding out.

But I guess Commissioner Paul is made of sterner stuff.

We begged him to stay and he was kind enough to agree.

What I am kind of worried about is that “crew of garbage collectors” to which he alluded.
Of course, he is right again.

Police officers face some of the most frightening situations. I have seen officers biting their teeth as they are being provoked and showing the patience of Job as they are tested by decadent forces. They took it like men, and emerged from those situations with distinction.

Some risk their lives in shootouts with bandits and are credit to the service. For those officers, we need to give thanks and say a prayer.

But it is at this point at which Commissioner Paul and I go in opposite directions.
I have heard of too many instances of people calling stations to beg for help and their pleas being ignored.

The old story of never having vehicles appears to be a time-proven excuse for officers who are a disgrace to the service. Yet in all my life, I have never heard of any officer being investigated for failing to act in one of these situations unless, as was the case most recently, someone is killed.

I want to ask the Commish what exactly has he, as leader of this crew of garbage collectors, done to inspire his men, to get them to understand their own roles in the communities in which they operate?

We hear of guns coming into the country illegally, drugs making its way into the lives of our youth, more and more corrupt officers and I wonder in this tiny country of ours, why it is that people who want us to believe that they mean well, that they care, can’t deliver on a solution to stop it.

The reality is that the public’s confidence in the service has fallen to unbelievable lows, a level from which if I am hearing Paul correctly, he is saying, there is no hope.

The Commish talks about his own passion and desire to change. I have no doubt he is sincere.
But the wicket on which he is batting is too tricky for someone who is faced with the kinds of challenges to which he is exposed.

I really would like to look at the Commissioner’s term and say I remember something significant about criminal activity that he has dealt with.

The reality though, is there is nothing to which I can point.

So in all fairness, we should let the man fete and enjoy himself. His message was almost clear enough to suggest he is fed-up and tired of having to deal with thrash.

I guess that if you too, had to deal with the kind of garbage he has to confront every day, one Old Year’s Night fete, would never be enough to stop the stench!

This is what you may call one lick bottom fockin Indian, probably looking for some wok from the PNM.

Feel he is ah tong boy.

GOVERNMENT would have to find at least $20 million to “buy out” the leave of 120 First Division police officers of the Trinidad and Tobago Police Service. Last week Thursday, Minister of National Security Martin Joseph took a proposal to Cabinet for Government to “buy out” the leave of all first division officers, in an attempt to deal with the manpower shortage in the Police Service.

First Division officers are those from the rank of Assistant Superintendents, Superintendents, Senior Superintendents, Assistant Commissioners, Deputy Commis-sioners and the Commissioner.

Newsday learned that the proposal was discussed at several weekly Commissioner meetings and at the end of last year a firm decision was taken to send a proposal to the Minister of National Security. In early January, Police Commissioner Trevor Paul took the proposal to Minister Joseph.

Yesterday, Deputy Police Commissioner in charge of Crime, Gilbert Reyes, confirmed that the first division officers had all agreed to the proposal for their leave to be bought by Government.

High ranking officers claimed in the proposal that the service will be disrupted if some of the officers go on leave because of the critical manpower shortage. Sources revealed that Minister Joseph was given the green light to proceed with the recommendation and submit a budget for the purchase of the leave of all the first division officers.

He will present this budget to Cabinet next Thursday. Some First Division officers have accumulated leave up to two years. Yesterday, President of the Police Second Division, Cpl Emrol Bruce told Newsday that the Second Division which comprises more than 75 percent of the Police Service has expressed interest in having leave purchased, but Government has not even entertained this proposal.

He said that officers in his division are the ones who matter and they are the ones who carry out duties in charge rooms, do foot and mobile patrols, respond to distress calls, carry out raids, searches and other key aspects of policing, and it is these officers who should be retained and not allowed to go on any long leave, in the interest of the service.

“This is why some of the crime initiatives will fail because the people who are responsible for the Police Service are not consulting with the rank and file,” said Cpl Bruce.

He added that with half of the service on leave, the manpower crisis remains. The service has 6,000 police officers and currently, more than half are on sick leave, accumulated leave, study leave and other special leave.

WITH 12 days still to go in the month, the country has already surpassed the murder figure for all of January 2007. Police sources said that for all of January 2007, 27 persons were murdered. As of yesterday, 30 persons were murdered in this month, so far.

And with almost two weeks left in this month, if this month’s murder rate continues, the country could very well surpass the January 2006 record tally of 38 murders. January 2005, saw 23 persons murdered.

Homicide officers said yesterday that they expect more gang-related murders and expressed concern over the brutal killings.

Annisette-George: East to get special criminal court

A special criminal court is to be established in east Trinidad to fast track the pace of criminal justice in the country, Attorney General (AG)Brigid Annisette-George signalled yesterday.
She made the announcement during a news conference at her office at Cabildo Chambers, St Vincent Street, Port-of-Spain.

“The ministry has acquired a parcel of land in east Trinidad for setting up a special criminal court, which would be focused on aiding the administration and fast tracking of criminal justice,” Annisette-George told reporters.

The AG added that her office would shortly be convening a consultative group of a wide number of stakeholders to solicit input in the design of a new criminal court.

“So, there are some projects in here aimed at easing the administration of justice,” she added.
The Government has long been criticised for the slow pace of the administration of criminal justice in the country.

Annisette-George said the new court would be adequately staffed.

“I would say, if it’s one thing we do not have a shortage of in T&T is lawyers,” she said, acknowledging the public’s concerns about lengthy case loads in the magistrates courts.

The AG said the proposed construction of new magistrates courts at Sangre Grande and Arima would also assist in reducing the case load.

“The judiciary has been looking to upgrade some of the courts...That is why the issue of the Judicial Complex in Arima and the new Sangre Grande Court is so very pertinent because that allows for the introduction of technology into the judicial process, which is not novel.

“It is just that we do not have the hardware, the building to support that,” she said.

Annisette-George assured manpower and equipment would not be an issue.

“The new criminal court will certainly be equipped with all the wherewithal for the technological advances to be employed in helping the cases,” she said.

Annisette-George said the recently-established Criminal and Justice Commission was presently reviewing the operations of the Police Complaints Authority as part of its
general remit.

AG: Vigilante groups illegal

ATTORNEY GENERAL Bridgid Annisette-George yesterday warned citizens that “vigilante groups are not recognised by law.”

She also cautioned that vigilantism “is really a dangerous course to be encouraging citizens to adopt.”

Annisette-George made the comments at her Cabildo Chambers office in Port-of-Spain. Although she did not directly comment on UNC A MPs Ramesh Lawrence Maharaj and Jack Warner’s launch of a community policing initiative in Macaulay, Annisette-George said any role citizens want to play in the fight against crime must be done in accordance with the law.

“While I think that all citizens have to play a role in fighting the scourge of crime, I would have thought that the national community’s support would have been enlisted in another way in accordance with law.”

She said the lines between a community group from a vigilante group may be difficult to distinguish but advised that vigilantism can leave participants “open to criminal proceedings. So that one has to be careful. ”

While the State and the police have their roles in fighting crime, the AG said all citizens have “a primary responsibility” to play to bring crime under control. From parents looking after their children’s well-being to adults obeying the country’s laws, Annisette-George added, “I think that is how the public should really be enlisted in the fight against crime.”

Reacting to critics of his hiring of security guards to protect villagers in Macaulay, Maharaj yesterday said private guards are used to protect Government offices and private business in cities like Port-of-Spain plus gated communities, and to transport prisoners.

“They are precepted by the Commissioner of Police and have powers of arrest. I don’t understand how they are called vigilante groups.”

He said the criticisms were an attempt to divert public attention from the Government’s failure to solve the crime problem.

“The real issue is why do people have to resort to paying private security guards?”

Nicole Dyer-Griffith assumes new office

The new Ansa McAL’s group corporate communications manager, Nicole Dyer-Griffith, lives by the mantra that life is too short for regrets.

“That’s wasting time; in that time you can be thinking about what’s next,” she said.
Dyer-Griffith took up the position last Monday, and spoke last week to the Sunday Guardian at Ansa McAL’s head office on Maraval Road.

She planned to get T&T’s people to recognise the significant contribution of the group.
Dressed smartly in a red skirt suit, she said when she gets involved in something she can be passionate and gives it 100 per cent.

She was also in charge of ensuring the image and reputation of the group was intact, along with managing the public’s perception of it.

Dyer-Griffith represented the Congress of the People in last year’s general election as the Diego Martin Central candidate. She was unsuccessful. That campaigning took up a lot of her time.
The deciding factor in accepting the position at Ansa McAL was the need to be driven. She also wanted to put her personal and professional life on track.

She described her personality as “red.” She stressed that she was passionate and did things with purpose.

Dyer-Griffith added that her mother instilled many values in her, some being strength, persistence, sharing and caring for others. This she attributed to much of her determination to follow through with her ideas.

Imbert: Ramesh's plan on 'vigilantism' is foolish

Government has denounced as "vigilantism" the plan of Opposition Chief Whip Ramesh Lawrence Maharaj to use watch groups assisted by armed private security personnel to protect communities against criminals.

Works Minister Colm Imbert yesterday claimed that Maharaj was trying to set himself up as some kind of "overlord".

Responding to Maharaj's crime plan, Imbert stated that it was "foolish".

"What powers would these private security personnel have and what law would they be operating under?" Imbert asked.

"Because private security personnel would not have police powers of arrest and so on. And therefore, by no stretch of the imagination could that be compared to the authority of the police. That is why they call it vigilantism.

"I don't see the point. That would be like a state within a state. It is the kind of thing you have in countries where you don't have the rule of law and where you have warlords."

Saying that there were such occurrences in Africa, where warlords decided who came and who went and declared the law, Imbert charged: "He (Maharaj) wants to become the overlord of some territory in Trinidad and Tobago."

Imbert said he was not taking on Maharaj, who was "on a frolic of his own" with all his allegations and plans. "He wants to be the next leader of the UNC and he is clearly trying to promote himself at the expense of Kamla Persad-Bissessar and others," the Works Minister said.

Maharaj has argued that the crime watch groups assisted by security personnel are legal and are created to protect the people and assist the Government and police in upholding the rule of law.

Responding to Maharaj's criticisms about Government's decision not to continue debate on the crime motion on Friday and instead to debate the Finance Bill, Imbert claimed that Maharaj knew that Government would have had to bring this Finance Bill in January. (See page 6)

"It is a routine measure and when the UNC was in office, the party did this five or six times," Imbert said.

Stating that the closing of the accounts was well known standard procedure, Imbert added: "So when I told him it was no surprise to him. But he said he was going to allege that Government was ducking the crime debate, so I just laughed at him."

Sando stroke patient sleeps in wheelchair

UNCOMFORTABLE NIGHT: Michael Worrell, 78, who suffered a stroke, spent Wednesday night in a wheelchair.

Michael Worrell, 78, who suffered a stroke, has been forced to sleep in a wheelchair because of bed shortage at San Fernando General Hospital.

Worrell, who sat in front of Ward 11 in a white T- shirt covered with blood stains, was unable to speak properly yesterday but managed to mumble a few words about how he felt, as he lay with his head tilted back on the wheel chair.

“They put me here, I don’t know why. I want to go home, where is my son?” he asked.

Worrell is the father of seven children. He resides at Buenos Ayres, in Erin. One of his sons, Christopher Preddie, said he found his father on the floor of his house on Wednesday night.

He called for an ambulance and Worrell was taken to the Point Fortin Hospital and later transferred to the San Fernando General Hospital where doctors confirmed he had suffered a stroke.

Preddie said his father waited all night for a bed but none was available so Worrel had to sleep in a wheelchair.

“For somebody who has a stroke it would be normal procedure for that person to get proper treatment. However, he has been just thrown aside in a wheelchair because they have no beds,” said Preddie.

Worrell is due to celebrate his birth on January 31. Preddie said his father had several tests done but has not been cleaned up.

“I brought clothes for him to change. They didn’t even change his clothes which smelt strongly of urine. He was not even given any prescription, neither anything to eat or drink.” he said.

SWHRA officials were unavailable for comment yesterday.

COMMISSIONER OF Police, Trevor Paul yesterday slammed detractors who said he should not have been at an Old Year’s night party at Soong’s Great Wall with his wife, when the country was at the mercy of cold blooded killers.

Critics hammered that given the gruesome barbarism inflicted by a murderous criminal element which has run amok, Paul should have stayed out of the party limelight. But he lashed back at them yesterday at the Trinidad and Tobago Manufacturers Association Crime Symposium, rebutting that he is entitled to a personal life and that the police have been unfairly and solely blamed for the sordid state of crime in the country.

People have been “very shallow” in their analysis of crime, he surmised.

“It has reached the point that if I try to socialise it’s an issue. So if my wife says to me, this year I want to go to an Old Year’s night party and let us go, there are those who say that I should not be there. I should not go to an Old Year’s night party. Well, I’m sorry, because I will go,” Paul said.

Recapping what the Police Service has come to, he described policemen as “practical garbage collectors taking what comes downstream, trying to clean it up. “If we were not taking up garbage probably our prisons would not be bursting at the seams with prisoners. Probably the courts, magistrates and judges might have had a very easy time, nothing to do, if we were not doing anything. The just under 400 illegal firearms we pulled off the streets, would not have been pulled off. The tonnes of drugs we were able to seize that would not have been done,” he stressed.

He noted that the problem is as they “collect downstream,” there isn’t an eye looking upstream calling for all social interventions to work together to slow “the rate of the badly produced youths that we are producing.”

“I recall… the then principal of St Augustine Girls’ High School and in her writing, she said that the people who are now shooting us, shooting others outside there, were once nice little babies in their brand name pampers, being hugged in peoples’ arms.”

Referencing a Newsday story on the high failure rate at police exams, Paul said it points to problems emanating out of the education system.

He said he is convinced that the police recruitment policy could be enhanced, but still feels strongly that it is not the policy that is bad.

“We are now doing psychological evaluations, polygraphs, so we are doing more. The problem still remains that the people who are coming forward to be police officers, probably are not our best graduates from our schools. But who come, we are able to select the best from among those.”

While technical advisor to the Minister of National Security, Richardson Franklin said that 18 new police stations are to be built to combat crime, former TTMA president, Anthony Aboud called on the head-table to take cognisance, that while there is good work by the police force, there are definitely some policemen who are not doing their jobs.

The symposium took place at the Hilton Trinidad, St Ann’s.

Politicians urged to lay off magistrates

POLITICIANS are being asked to refrain from making statements which has the likelihood of impugning the integrity of magistrates.

The call came from the Association of Magistrates yesterday after it said it noticed an alarming trend by politicians.

In a three-line statement, the association said it “strongly denounced this as these statements can have the effect of eroding public confidence in the magistracy and the administration of justice generally.

“In light of the influence that these politicians exercise over their constituents, the association urges politicians to desist from making unsubstantiated public pronouncements,” the statement added.

Although not referring to a particular incident, only recently claims of bias in the judicial process were made by Opposition Leader Basdeo Panday as he was commenting on the dismissal of corruption charges against former PNM energy minister Eric Williams by Senior Magistrate Lucina Cardenas-Ragoonanan.

Manning and Joseph have often spoken about the 360-degree radar coverage being crucial in stopping the flood of illegal guns and drugs fuelling many of the violent crimes in the country.
The radar had helped Coast Guard and Organised Crime, Narcotics and Firearms Bureau officers make several drug busts in the Gulf since it began operating in 2006.

Technicians spent the day yesterday working on the radar, which is capable of detecting and tracking boats as small as fishing pirogues, as well as being able to follow the target, provide real-time updates on its location, direction and speed.

The equipment was being tested yesterday evening after being removed and dismantled under the security of Special Anti-Crime Unit (SAUTT) officers. Workmen at the scene declined to speak with the Express.

The company has advertised the system as having the ability to prevent illegal immigration and drug smuggling, illegal fishing and terrorist activity.

It has the capability to detect submarine periscopes and airborne targets on a 24-hour, all-weather basis, from a command centre on a colour screen showing an outline of the country's coastline.

Payments for the equipment were made between 2002 and 2006.

In 2001, Prime Minister Manning visited Israel and met then prime minister Ariel Sharon to discuss security matters.

Legislation to deal with dangerous dogs in this country has been lying around for the past seven years waiting to be proclaimed by the President.

In 2000, under the United National Congress government, then attorney general Ramesh Lawrence Maharaj piloted to Parliament an act entitled "The Dangerous Dogs Act, 2000", to provide for regulating the keeping of dangerous dogs which present a serious danger to the public, to make further provision for ensuring that such dogs are kept under proper control and for connected purposes.

The act was debated in both the House of Representatives and the Senate and was passed.
In order for a bill or act to become law, however, it must be proclaimed by the President.
The UNC government demitted office and never proclaimed the act. The People's National Movement government has been in power for the past six years and also failed to proclaim the act.

Under the act, where a dangerous dog injures a person, the owner or keeper of the dog commits an offence and is liable, on summary conviction, to a fine of $100,000 and imprisonment for five years.

The act also states that where a dangerous dog kills a person, the owner or keeper of the dog commits an offence and is liable, on summary conviction, to a fine of $200,000 and to imprisonment for ten years.

The act states that a person who incites a dog to attack another person commits an offence and is liable, in addition to any other penalties he may incur under the act, on summary conviction to a fine of $25,000 and imprisonment for one year. The act also prohibits persons from importing and breeding dangerous dogs. If a person does so then he or she is liable, on summary conviction, to a fine of $100,000 and two years imprisonment.

Persons who breed dangerous dogs and advertise them for sale or even give as a gift a dangerous dog also faced penalties under the act-a fine of $100,000 and imprisonment for two years.

If the act had been proclaimed within three months of coming into force, every owner of a dangerous dog would have been required to register that dog to the authorities.

It seems as though any fockin Bill that was passed by the UNC whilst in Gov't is totally neglected by this fockin duncee ass nigga fockin PNM administration.

The same thing happened to the fockin Equal Opp. Bill. The Criminal Injuries Compensation Act and so many others.

Parliament rules against COP

Eight members of the Congress of the People (COP) could not enter Parliament on Monday wearing shirts with their party’s symbol of a series of circles because they are neither elected nor nominated members of the Lower and Upper Houses, Parliament officials said yesterday.

In response, attorney Prakash Ramadhar, one of the eight COP members who were denied entry into Parliament, said he could see “no logic” in this decision and said it begged the question about whether political party symbols should be worn in Parliament by anyone at all.

Ramadhar unsuccessfully contested the Caroni Central seat for the COP, which was won by the UNC Alliance’s Dr Hamza Rafeeq.

Parliament officials said the Parliament’s rules clearly state that no member of the public can enter the Red House wearing the insignia of any political party. They explained PNM and UNC parliamentarians (elected MPs and senators) are allowed to wear party emblems such as balisier ties and rising sun pins because they are elected and nominated Members of Parliament.

Told about this yesterday, Ramadhar said he understood the rationale for not politicising what goes on inside the Parliament Chamber because the essence of Parliament is to deal with the people’s business as opposed to satisfying partisan interests.

However, Ramadhar questioned whether the parliamentarians, who proudly display the insignia of their parties at every sitting, were representing the people who elected them or their parties political agendas.

NATIONAL SECURITY Minister Martin Joseph yesterday declined to say whether or not he would resign after Opposition MP Roodal Moonilal penned a draft resignation letter for him and offered on Monday to present it to Prime Minister Patrick Manning.

Asked yesterday whether he felt pressured to resign after Monday’s crime debate in Parliament, which included Moonilal’s mock resignation letter and with the homicide rate already in double digits for the new year, Joseph said: “I have no comment to make.”

Sources yesterday said Prime Minister Patrick Manning would not fire Joseph despite the minister’s admission last week that some anti-crime measures had not worked.

A 22-YEAR-OLD man who was questioned by police in connection with over 20 murders committed in a three-year period, was himself murdered outside an apartment building in Cocorite yesterday.

However, investigators claimed the mortally wounded man was taken by persons unknown to Port-of-Spain General Hospital. He was dropped off at the Accident and Emergency Department by the persons who left without telling hospital officials anything. When doctors checked on the man, he was already dead.

The victim was identified as Keiron “Blood” Burnette of Waterhole, Harding Place. Police said he was a member of the G-Unit gang. According to a police report, at about 10.30 am, residents of Building 5, heard several loud explosions and on checking, saw blood on the ground and a car speeding off.

An investigating officer yesterday confirmed that Burnette was a member of the G-Unit gang and was questioned numerous times for murders in Port-of-Spain, Cocorite and surrounding areas. However, the officer said that a motive was yet to be determined.

Burnette, police said, had several matters pending before the Port-of-Spain Magistrates’ Court for firearms possession, shooting and wounding. At the scene yesterday, family members and residents refused to comment on the incident.

On September 16, leader of the G-Unit gang, Kerwin “Fresh” Phillip of Charford Court was shot 20 times by gunmen armed with semi-automatic guns, while walking to his car at the corner of Oxford and Henry Streets, Port-of-Spain at about 1.45 am. He died on the spot.

Another member of the gang, Allan “Mento” Wills of Siparia Hill, East Dry River, was gunned down three days later, on September 19 near the Corner of Prescott Alley and Quarry Street in Port-of-Spain.

On October 5 at about 9 am another gang member Kwame “Butters” Julian, 26, was seen standing along Observatory Street talking to a taxi driver when a lone gunman walked up behind him and shot him in the back. Police said that when Julian slumped to the ground, the gunman stood over him and fired several shots killing him instantly.

Police confirmed that he was shot more than three times in the head and back. Investigations are continuing.

NATIONAL Security heads summoned to a retreat at the Salybia Beach Resort from Friday afternoon to yesterday, failed to supply any meaningful new anti-crime initiative to Minister of National Security Martin Joseph.

A dejected-looking Joseph left the beach resort shortly after 10 am, without any of the new measures he had hoped to get from the security top brass, to add to Government’s crime motion which was delivered in Parliament yesterday.

Almost all of the initiatives offered to Minister Joseph were already used and those proposed were reportedly shot down, sources said.

During the retreat, the high-ranking officers were addressed by security consultant Anthony Watkins of Watkins and Associates.

They were also addressed by Joseph who spoke on key issues relating to management structures. He advised officers of the importance of putting certain management structures in place for the security agencies to perform at its best.

The participants were also reminded of the need to work more closely and get to know each other rather than operating alone. Participants were also reminded of the need to set up better systems for disseminating work plans.

The officers were introduced to the officers of the newly formed National Information Co- ordinating Centre, which is based at Long Circular Road, Maraval and was established to deal with the upsurge in crime.

Senior officers told Newsday that setting up the Special Anti-Crime Unit (SAUTT) and other elite agencies to deal with crime, is not the answer to fighting crime.

They maintained yesterday that they see nothing wrong in a gun amnesty being introduced and again questioned the refusal by government to put this amnesty in place.

Yesterday, Opposition Leader Basdeo Panday told Newsday he too is baffled as to the reason why government has shot down the proposed amnesty, especially at a time when the country is facing an upsurge in murders in which the gun is the weapon of choice.

“Try it and see if it will work and if it does not, then the government can tell the citizens that they tried and the initiative failed,” Panday said.

At the end of the retreat at Salybia yesterday, officers were treated to buffet-styled lunch consisting of vegetable soup, pigeon peas rice, coo-coo, callaloo, flying fish, stewed lamb, green salad and a choice of very sweet grapefruit juice or fruit punch. Dessert consisted of Vanilla ice- cream.

Colonel Roland Maundy used the opportunity to venture out of the hotel to purchase freshly picked sorrel from a nearby shop.

In the first instance their purpose for goin up Salybia is to put money in the Boynes family pocket. Payback.

More than half of the total number of police officers who wrote examinations in 2006 failed to make the grade.

As a result, the Police Service Commission, in its 2006 report, has expressed its concern over the high failure rate at the exams.

Officers seeking promotion to the rank of corporal totalled 1,322. Of that amount 254 were absent, which meant 1,068 wrote the exam. Only 74 were successful, while 994 failed.

There were 1,436 who sought promotion to the rank of sergeant. Of that total 64 were absent, while only 100 were successful. Those who failed totalled 1,272.

Overall, the examination figures told a sorry tale. Of the 2,440 who wrote the exams; 174 were successful, while 2,266 failed.

In relation to discipline, the report pointed out that disciplinary matters that do not carry a penalty of dismissal were delegated to the Commissioner of Police by the commission.

Such matters are heard by “one man tribunals.”

A total of 35 matters were heard and determined.

Penalties included reduction of remuneration, transfer, imposition of a fine, or the officer was reprimanded.

The commission, in its report, has also expressed its concern about the number of court matters against police officers. Some cases are dismissed for want of prosecution due to non-appearance in court of police complainants

The commission subsequently sought legal advice, and now has introduced disciplinary procedures, concurrent with criminal proceedings.

However, if it is found that disciplinary proceedings may compromise the criminal proceedings, the commission will hold its hand on taking action.

The commission had noted with concern over the delay by the Commissioner of Police to appoint investigating officers to start disciplinary proceedings against officers who are the subject of court charges.

It is very suspicious the way in which the case against Former Energy Minister Eric Williams was wrapped up by the prosecution. Out of reports published in the press on December 8, 2007, five very troubling questions arise.

Where is state witness Natasha Beharry who failed repeatedly to show up in court to give evidence? If she is alive and can be found, why has she not brought to court and failing cooperation from her, why has she not been prosecuted for wasting court time or contempt refusing to attend court? Does the State intend to pay for the incomplete services of British Prosecutor Peter Thornton QC? Why was the presiding magistrate not moved by the fact the Thornton was unavailable because of his appointment to the High Court in London, to grant even a short adjournment so that a new prosecutor could be appointed? Why did the magistrate also not take more forceful steps to bring witness Beharry to court?

On December 7, 2007, the prosecution was forced to close its case without Beharry's evidence - because she has failed on several occasions to come to court - and without a lead prosecutor - as Thornton was unavailable. The prosecution asked for an adjournment to get a new prosecutor and the magistrate refused, forcing the prosecution to close its case and leaving it with no lead prosecutor to cross examine Williams' witnesses.

The people of TT got short-changed because the magistrate's decision was not based on ALL the evidence available. The State had no prosecution at the most critical point of the case.

DPP Geoffrey Henderson needs to explain this situation to the nation because it looks like one of three things - the prosecution threw away the case, the magistrate made an injudicious ruling or both.

We have already seen how the justice system can be manipulated in other cases. It was a top PNM official who said the PNM takes care of its own. That statement was in relation to these same Dansook allegations.

SECRETARY General of the Sanatan Dharma Maha Sabha (SDMS) Satnarine Maharaj yesterday lashed out at politicians over the state of the country, deeming TT as a “bogus and sham democracy.” He claimed although it appeared people were free, “there were elements around which were organised to deny us the freedom we should enjoy.”

Maharaj made these strong statements at Maha Sabha headquarters in St Augustine where a ‘puja’ (Hindu prayer) was held to mark the start of the New Year. “While the firecrackers and fireworks had expelled its energy, people were now forced to go back to ordinary living by facing the crises that plague us day after day,” Maharaj said.

He added that last year the country experienced a peaceful General Election as compared to the carnage in Pakistan and Kenya. However, he questioned whether this was sufficient. “We see leaders on a daily basis going to and from court, judges being threatened with the Chief Justice being tormented for two years and almost destroyed. There is rising crime where more blood is flowing on the streets than water in WASA pipes, a healthcare system in disarray, high food prices and a nation starving in the midst of prosperity,” Maharaj slammed.

He further remarked that “we may have survived but we survived in a bogus democracy.”

Maharaj also lamented that TT was “the first democratic country that never held a referendum on any topic”, with “policies and programmes being introduced” without consultation of the people. He cited an example of the proposed smelter plants, saying health concerns were raised by the citizens but instead of having a referendum on the issue, “it was being rammed down the throats of the people.”

He added that the brainpower of the land was also moving away with businessmen having to conduct their business abroad. “Don’t congratulate yourself that we are a democracy. We are a bogus democracy where only those with political power enjoy the benefits,” he said. He stated that “to be a true democratic nation everyone had to enjoy the benefits of democracy.”

He claimed that it was almost six years ago, “judges in London ruled that we (the Maha Sabha) should be given our democratic right” and should be paid cost and compensation and loss of earnings. However, it is more than two years and the matter has not been heard.” “How could this be democracy? This is bogus democracy,” Maharaj said as he was dealing with the Maha Sabha case which went before the Privy Council on the issue of the granting of a radio station licence.

He further called for any matter dealing with the constitutional rights of the people to be cost free, saying that people should not have to pay to preserve their constitutional right. “The biggest culprit in denying the people their right is always the Government and the state who are always trying to erode the people’s rights,” Maharaj insisted.

He added that “the ordinary man did not have access to the courts and only those with money could afford to preserve their rights.”

Maharaj ended by calling upon the people “to become vigilant and always stand up, speak out and fight against anybody who would deny us the freedom.” He also called upon the politicians to involve the citizens in the state’s administration.

Cardenas-Ragoonanan stands behind decision

Senior Magistrate Lucina Cardenas-Ragoonanan has slapped down allegations by Opposition Leader Basdeo Panday questioning the impartiality of her decision to free former Energy Minister Eric Williams of corruption charges.

Cardenas-Ragoonanan said in a telephone interview with Cable News Channel Three yesterday morning that shadows cast over her objectivity and non-alignment were “without merit.”

“Why does everything have to be politics. I do my job and I wish he (Opposition Leader Basdeo Panday) would really read the evidence,” said Cardenas-Ragoonanan.

“Maybe the time has come for me to say something because this is absolutely ridiculous. I mean, so what does that mean: that one, whatever position you are in, you are not a citizen of this country and whether you are aligned to anything. I am not aligned to anything.”

On Monday Cardenas-Ragoonanan discharged Williams of seven counts of unlawfully accepting $75,000 from People’s National Movement Mayaro Councillor Dansam Dhansook for a seismic project in Galeota in 2003.

Williams had served as Energy Minister from 2002. He resigned from the post in January 2006 after being charged.

Cardenas-Ragoonanan’s judgment prompted Opposition Leader Basdeo Panday to question whether Cardenas-Ragoonanan, who became a senior magistrate in 2000, was “too closely aligned to the ruling party” of which Williams was a member.

But Cardenas-Ragoonanan, who has served more than 12 years on the bench, said that the case against Williams did not suffer from inadequate and undemocratic decisions.

“I went to the law. I went to what I am required to do and I made my decision purely based on that. Absolutely nothing else. I have absolutely no alignment with the PNM,” she said.

Her ability to perform duties as a senior magistrate and her integrity have suffered several assaults from members of the Opposition United National Congress in the past following the active participation of her husband, Harry Ragoonanan, in the PNM.

Ragoonanan is the chairman of the party’s Oropouche East constituency.

“Obviously, it is absolutely unfair. So what, I am not an individual? I do not have a mind of my own? I’m almost 50 years old, I didn’t come out yesterday. I’ve been sitting on the bench for the last 13 years, acting very impartially all the time. I always have and will continue to do so,” Cardenas-Ragoonanan added.

The appointment of Cardenas-Ragoonanan as a temporary judge last year was withdrawn by the Judicial and Legal Service Commission following the opposition of the UNC.

‘Small Saleem’ gunned down

A FORMER state witness who was an ex-member of the Jamaat al Muslimeen was gunned down at Seventh Avenue in Barataria yesterday.

Saleem “Small Saleem” Rasheed, 38, died on the spot after he was shot ten times in the neck, head and chest, investigators said.

A police report said that around 10.45 am, Rasheed was on the sidewalk at Seventh Avenue, where he was contracted to do work for the Unemployment Relief Programme.

However, the other employees did not show up for work and Rasheed decided to mix the concrete himself.

A gunman ran up to Rasheed, called him by his name then shot him several times about the body.

He collapsed on the ground where he subsequently died.

Detectives said he was killed execution style.

Eight spent shells were recovered from the scene.

Residents and other members of the Barataria mosque, which Rasheed attended, gathered at the crime scene after the shooting.

Members of the mosque threatened media personnel, saying they did not want any photographs taken of Rasheed lying dead on the ground.

Asked to comment on Rasheed’s murder, one of the Imams said: “Inna lil Allah innas illa raa je oon.” (From Allah we come and to Allah we return).

One of the other members of the mosque said Rasheed had been good to all.

However, other men, purporting to be Muslims, were heard saying: “Them fellows don’t know they start the war.”

Rasheed testified last year in the conspiracy to murder trial against Jamaat al Muslimeen leader Yasin Abu Bakr.

Bakr, Brent Miller (also called Big Brent), David Millard (also called Buffy) were accused of plotting to kill Rasheed and Zaki Aubaidah, Bakr’s son-in-law, on June 4, 2003, at Diego Martin.

Some time later, Julia Bowen and her husband Adil Ghany and Rasheed were shot at while at MovieTowne Complex in Mucurapo.

Rasheed was shot about five times in the groin and leg region.

Bowen was killed and Ghany sustained gunshot wounds during the drive-by shooting.
Bakr was exonerated of the charge.

Meanwhile, no suspects have been held for Rasheed’s killing.

Homicide officers are continuing investigations.

And none ever will.

Mother of four shot dead at home

A 36-YEAR-OLD mother of four was shot dead yesterday morning at her Farm Road home in St Joseph.

Cheryl Gabrielle, of Raspberry Drive, was shot five times in her head. She died on the spot.
A police report said that around 1.30 am, residents heard several loud explosions and when they checked Gabrielle was found lying on the ground in a pool of blood.

The body was viewed by the district medical officer and ordered removed to the Forensic Science Centre for an autopsy.

Gabrielle’s children were at an aunt’s house when the gunmen stormed her home, relatives said yesterday, in an interview at the Forensic Science Centre.

Relatives, who asked not to be identified, said Gabrielle did not celebrate Christmas fully since she got furniture items late.

“She sent the children to another relative’s house because the place was not ready for Christmas,” she said.

Gabrielle wanted to purchase curtains and vinyl yesterday morning, in time to celebrate New Year’s with her children.

The relative said Gabrielle had been asleep when the gunmen kicked down her front door.
“She heard the commotion and ran to lock herself in the children’s room because it has a lock...She called the police and the men then broke down the door and killed her,” the relative said.

The family member said Gabrielle was gunned down as if she was a man.

“Don’t they have a mother or sister? They have no respect for human life. She is not a gangster but they kill her like she is a man,” the relative said.

One of Gabrielle’s close relative, close to tears, said: “God said vengeance is his. I leave it in his hands. I can’t do anything but pray. I hope and trust in God’s justice. Just as you kill a man they need to kill them back.”

Relatives described Gabrielle as a loving person “who was mother and father to all.”

Detectives suspect Gabrielle’s death may be linked to a shooting last week, when one of her relative’s was shot while he was going to take a maxi taxi at the Priority Bus Route.

The relative, who was shot in his foot and back, remains warded at the Eric Williams Medical Sciences Complex in stable condition.

No suspects were held by the police.

Homicide officers are continuing investigations.

Gabrielle’s death pushes the murder toll to 377 for the year, according to the Homicide Bureau.

"Spared" is a word that strikes as a dagger into the heart of justice whenemployed as a malicious euphemism for "exonerated" . It is a word thatdiscredits those who use it to impugn the character of the CJ against thebackdrop of the explicit Mustill Report, which if it does anything at all,indicts the Prime Minister and his government shamefully.

Notwithstanding his injudicious garrulousness noted by the Tribunal, CJSharma has been completely vindicated and exonerated of all charges and hischief accuser now stands starkly naked in his public guilt.

At the very least the Prime Minister is guilty of over zealousness inpursuing unsubstantiated accusations described as "fragmentary calumny" inthe face of damning evidence against the Chief accuser.

Justice demands that Mr. John Jeremie be brought to justice for hisinvolvement in the affair as much as Mr. Sherman Mc Nicholls must beprosecuted for his own self serving role. He is already disgraced in thepublic eye and remains an excrescence upon the Judiciary.

The Sharma Affair has brought odium upon Government and its hirelings andrevealed the viciousness of business machinations in the arena of politics.The corrupt dealing of named land developers who collaborated with officialsto form the accusing corps demands prosecution.

Not only should Mr. Sharma's full costs be met by the Government withoutdemurring, but he should be compensated for the unjust persecution he suffered. His prosecution was hallmarked by vindictiveness.

What has happened with regard to the humiliation of the Honourable Chief Justice of Trinidad and Tobago is an extremely serious matter. It is a matter that should receive a full examination as the systemic forces and the supporting characters that precipitated this monsterous perversion of our justice system must be exposed. If necessary criminal charges should be laid against John Jeremie for perverting the course of justice. There is now an abundance of evidence to suggest that Jeremie ought to face the full glare of the law.With respect to the criminal charges agsint Sharma we must note that they were laid on the basis of the evidence of one man, Sherman McNicolls.

When the moment came for McNicolls to face Pamela Elder he folded. Elder commented after the collapse of the case agaisnt Sharma that it was a travesty of justice. Speaker lawfirms gets huge government contracts

Hobsons’ offices are located in San Fernando, Port-of-Spain, Chaguanas and Point Fortin and some of its clients include Caroni (1975) Limited, Petrotrin, National Agricultural Marketing and Development Corporation (Namdevco), The Home Mortgage Bank, Trinidad Cement Limited (TCL), the San Fernando City Corporation and other regional corporations.

The annual earnings of this form of legal representation by Hobsons are said to be in the millions of dollars. But Sinanan said he saw no conflict in his being a senior partner in the law firm getting work from the State and his role as Speaker of the House, which office calls for transparent, impartiality.

Sinanan was re-elected House Speaker for a consecutive term.

“I do not personally handle government work at Hobsons,” he said.

He said he never used his public position and didn’t have the title of “MP” or “Speaker” behind his name on the firm’s letterhead. ---Newsday

COP wants Mc Nicolls resignation

THE CONGRESS of the People (COP) yesterday charged that the Section 137 tribunal report, which cleared Chief Justice Satnarine Sharma and paved the way for him to resume duties, shows there was a “vendetta” to remove Sharma from office.

In a statement from the office of COP party leader Winston Dookeran, the Congress called for the immediate resignation of Chief Magistrate Sherman McNicolls and for President George Maxwell Richards to appoint a Commission of Inquiry to investigate whether or not a political conspiracy was hatched against the Chief Justice.

The COP was particularly harsh in its condemnation of Mc Nicolls in this entire affair, drawing reference to a section of the report’s conclusion, which said: “Either he (Mc Nicolls) was in the grip of conspirators who for some reason wanted to have the behaviour of the Chief Justice examined by an enquiry rather than in a criminal court, or at least wanted him to be removed from office without being in peril of prison.

“Or the Chief Magistrate really believed in the opinion that his statements were in some way his property, to be used by the organs of the State only in a way of which he approved an extra-ordinary misconception for an experienced magistrate. Either alternative raises more questions than it solves.”

The COP claimed Mc Nicolls’ action in the CJ affair has undermined public confidence in the Judiciary and said he should deliver all outstanding judgments and resign immediately.

“His continued presence cannot help restore public confidence in the administration of justice.

The party reiterated its March 30 call for the President to establish a Commission of Inquiry that would be able to subpoena witnesses so that the alleged role of persons in the ruling People’s National Movement (PNM) in this matter could be determined.

“The country needs to know the truth and a commission of inquiry with the power of subpoena is what is required now,” the COP stated.

Faeces thrown at city Magistrate

PROCEEDINGS at the Port-of- Spain Eleventh Magistrates’ Court came to an abrupt halt yesterday morning after a prisoner threw faeces at the presiding magistrate.
Magistrate Michelle Maraj-Brown was sitting on the bench shortly before 10 am when Tyrone Clarke appeared before her.

Clarke who is charged with arson and malicious damage, told Maraj-Brown, “Mam, I have a paper from the doctor to show you.” He then reached into his back pocket took out a crix plastic bag and something wrapped in paper. By the time officers realised what was happening, Clarke flung the package (faeces) straight at Magistrate Maraj-Brown.

The petite magistrate screamed out in horror as the entire courtroom became engulfed with a foul stench. The clerk and prosecutor rushed to the aid of a traumatised Maraj-Brown and whisked her away to the back, while police officers subdued Clarke and dealt him several blows to the body.

Although the faecal matter did not reach the magistrate’s chair, the walls, benches, attorney’s bar and some officers were not spared. Persons waiting to have their matters heard, made a mad dash for the door as walls were splattered with the waste matter.

Reasons for Clarke’s behaviour remain unclear as there is no record to show that he suffers from mental problems. The court was immediately shut down and a MTS cleaning crew was brought in to wash and sanitise the area but, for all the soap, bleach and water, the scent remained and soon the unpleasant odour could be experienced throughout the corridors of the new wing.

Word of the unfortunate incident spread to other magistrates and like a chain reaction, matters were being dealt with quickly and prisoners sent back downstairs.

Fuss nigga like shit eh.

FORMER Energy Minister Eric Williams will have to wait until next Friday to know if he would go on trial for corruption and misbehaviour in public office, or if the matter will be thrown out.

The proceedings hit a snag yesterday morning after a representative from the licensing office failed to show up. The defence led by Desmond Allum SC had summoned both the Head of the Immigration Department and the Transport Commissioner to verify documents but only a representative sent from immigration attended court.

Officer Lucienne Matthews stood in the witness box for about ten minutes to verify documents relating to the case. However when the defence called for the witness from the licensing department there was only silence.

According to the defence, a summons was sent to the Transport Commissioner’s office. Magistrate Lucina Cardenas- Ragoonanan sitting in the Port-of -Spain Fourth Magistrates’ Court was forced to stand down the matter as her clerk made enquiries on behalf of the defence.

When the matter resumed a short while later, defence attorney Allum attempted to have a document from the licensing department tendered into evidence. However, State prosecutor George Busby strongly protested arguing that under the Sections 37 and 22 of the Evidence and Admissions Act, documentation of that nature cannot be tendered into evidence, unless the Transport Commissioner or someone appointed by him, takes the stand.

Hobsons: Sinanan signature not in briefs

THE LAW firm Hobsons yesterday said that even though House Speaker Barry Sinanan is a senior partner in its San Fernando law firm, his signature is not on record in legal briefs from State Corporations which the firm represents.

Attorney Sherwin Seenath, one of the three senior partners, told Newsday yesterday that all matters from State corporations are handled by a battery of other attorneys. “All contentious matters from corporations are handled by me and Roger Kawalsingh,” Seenath said.

Kawalsingh, who is a junior partner in the firm denied yesterday that Hobsons was one of the law firms which the Home Mortgage Bank retains for legal services. Kawalsingh said that House Speaker Sinanan’s senior partnership in Hobsons, was not connected to the law firm’s legal representation for some State corporations, among which are Petrotrin, Trinidad and Tobago Mortgage Finance, Water and Sewerage Authority and First Citizens Bank.

The Speaker is being threatened with a judicial review lawsuit from UNC MP for Tabaquite Ramesh Lawrence Maharaj, who heads the Civil Rights Association, and who intends to challenge his impartiality on the basis of his partnership in Hobsons.

The issue played itself out in the House of Representatives on Monday during the ceremonial opening of Parliament. The UNC opposition through its Chief Whip Maharaj failed to get the Speaker’s agreement to debate items on the Order Paper and Speaker Sinanan adjourned the House to a date to be fixed.

Seenath told Newsday that Sinanan’s speciality was conveyancing, but asked whether the Speaker was an active partner in Hobsons, he reiterated, “It is highly unlikely he is on record. All contentious matters are handled by myself and Mr Kawalsingh.”

Kawalsingh told Newsday that Hobsons has represented State corporations “through several various political administrations,” including the United National Congress. Maharaj is contending that the Speaker is obliged to declare his interest in the law firm to members of Parliament.

The Speaker said he declared the Hobsons interest to the Integrity Commission, stating that he did so instead of “hiding behind a trust” which he was entitled to do. The Speaker’s partnership in Hobsons was mentioned in a letter from Maharaj to the Speaker dated December 18.

HOURS after he received an official copy of the Lord Mustill Tribunal report, President George Maxwell Richards revoked the suspension of embattled Chief Justice Sat Sharma, paving the way for him to return to his job at the Hall of Justice, Port-of-Spain, today.

In a 58-page report, the three-member tribunal concluded: “In light of the matters set out in our report, the tribunal humbly recommends to your Excellency that the question of removal of the Honourable Satnarine Sharma from the office of Chief Justice of Trinidad and Tobago should not be referred to the Judicial Committee (of the Privy Council).”

The report, dated December 14, was handed over to the President at 10 am yesterday by Ida Eversley, secretary of the tribunal which was appointed on May 16, to determine whether Sharma should be removed from office.

After perusing the report, President Richards dispatched a one-page letter to Sharma, pointing out that in accordance with Section 137 (4) (a) of the constitution, the suspension which he (Richards) imposed on Sharma on June 13, was revoked. A letter was also sent to acting Chief Justice Roger Hamel-Smith informing him that his appointment was revoked, with immediate effect.

Sharma has wasted no time as he will return to the Hall of Justice this morning to take up his duties. But he was not invited to last night’s Christmas dinner at the Queen’s Park Oval for judges, which was attended by President Richards. Contacted last night, Sharma was happy at being cleared by the tribunal comprising retired Privy Council Judge Lord Michael Mustill, Sir Vincent Floissac QC and Dennis Morrison QC.

Sharma told Newsday: “I want to thank God for giving me the strength and courage to be able to face what I have been through. I also want to thank all the people who prayed for me, sent me cards and letters. I am happy at the decision of the tribunal.”

The Chief Justice added: “I am anxious to get back to work, there are a few things which I started and which I want to complete. Based on the report, I think there is still some investigation to be carried out in this matter.”

According to the tribunal, the picture presented to them ‘almost defies belief.’ The report stated, “we find contradictory accounts given by the Chief Justice and the Chief Magistrate (Sherman Mc Nicolls) on oath, of meetings between them where the discrepancies cannot be explained away by misunderstandings or poor recollection.”

The report continued, “we see the Chief Justice publicly arrested, and later ushered three times into the dock in a criminal court to undergo a summary trial on charges based on allegations by the Chief Magistrate, and then on the last occasion, ushered out again in consequence of the refusal by the Chief Magistrate to give evidence against him.”

The tribunal heard during the oral evidence where counsel for the Chief Justice publicly accused Mc Nicolls of having been bribed to mis-try criminal proceedings against the Leader of the Opposition, former Prime Minister Basdeo Panday.

The tribunal said they heard allegations against the former Attorney General John Jeremie, who could have given oral evidence to rebut them, but he did not. “The air was full of rumour, innuendo and gossip, around and across deep political divides. We need not go on. The picture is ‘troubling’ indeed, both for the tribunal and for the peoples of Trinidad and Tobago.”

The tribunal members asked one question - has it been proved that the allegations against the Chief Justice are true, that he attempted to influence the Chief Magistrate to reach a verdict favourable to Panday in his integrity trial?

“We start with the evidence of the Chief Justice. His conduct during the time under review was not in our judgment, without blemish. The jovial chat with Sir Timothy Cassel (on a BWIA plane) about a pending case, his raising of the Hindu wives topic on more than one occasion, his intemperate press release, the overheated terms of his complaint to the (Judicial and Legal Services) Commission.

“All these combined with the impression gained during the oral evidence to suggest a propensity to speak and write more freely than was wise, without the balanced sensitivity and distance which should be the hallmarks of a senior judge.”

The report continued, “in contrast, when we come to the Chief Magistrate the picture is quite different.”

The tribunal wondered what could have been the motive of the Chief Magistrate in filing his complaint when both he and Sharma had been on good terms for years. The tribunal found it strange that the Chief Magistrate took so long to file his complaint to the Attorney General. They also found that Mc Nicolls’ conduct was shrouded in mystery which they have not been able to dispel. They also touched on the land transaction which Mc Nicolls was involved in, in the middle of the Panday trial. They could not figure out why Mc Nicolls took so long to report the allegation.

“The Chief Magistrate had ample time to put together the document destined for two high officers of State, yet his effort of May 5, 2006, was so thin that it had to be reinforced less than a week later by a second statement, and the various later versions were not wholly consistent with those which launched the present proceedings.” The tribunal found that Mc Nicolls had no explanation for his last minute change of heart by not testifying against Sharma on March 5 causing the criminal trial to collapse.

“Either he was in the grip of conspirators who for some reason wanted to have the behaviour of the Chief Justice examined by an inquiry rather than in a criminal court, or at least wanted him to be removed from office without being in peril of prison.”

It didnt take a fokin genius to figure this out.

Their IGNORANCE is the primary weapon of containment. A great man oncesaid, 'The best way to hide something from Black people is to put it in a book.' We now live in the Information Age. They have gained the opportunity to read any book on any subject through the efforts of theirfight for freedom, yet they refuse to read. There are numerous books readily available at Borders, Barnes & Noble, and Amazon.com, not tomention their own Black Bookstores that provide solid blueprints to reach economic equality (which should have been their fight all along),but few read consistently, if at all.

GREED is another powerful weapon of containment. Blacks, since the abolition of slavery, have had large amounts of money at their disposal. Last year they spent 10 billion dollars during Christmas, out of their450 billion dollars in total yearly income (2.22%).

Any of us can use them as our target market, for any business venture we care to dream up, no matter how outlandish, they will buy into it. Being primarily a consumer people, they function totally by greed. They continually want more, with little thought for saving or investing.

They would rather buy some new sneaker than invest in starting abusiness. Some even neglect their children to have the latest Tommy or FUBU, Andthey still think that having a Mercedes, and a big house gives them 'Status' or that they have achieved their Dream.

They are fools! The vast majority of their people are still in poverty because their greed holds them back from collectively making better communities.

With the help of BET, and the rest of their black media that oftenbroadcasts destructive images into their own homes, we will continue to see huge profits like those of Tommy and Nike. (Tommy Hilfiger has e ven jeered them, saying he doesn't want their money, and look at how thefools spend more with him than ever before!). They'll continue to show off to each other while we build solid communities with the profits from our businesses that we market to them.

SELFISHNESS, ingrained in their minds through slavery, is one of themajor ways we can continue to contain them. One of their own, Dubois said that there was an innate division in their culture. A 'Talented Tenth' he called it. He was correct in his deduction that there aresegments of their culture that has achieved some 'form' of success. However, that segment missed the fullness of his work. They didn't read that the 'Talented Tenth' was then responsible to aid The Non-TalentedNinety Percent in achieving a better life. Instead, that segment has created another class, a Buppie class that looks down on their people or aids them in a condescending manner. They will never achieve what wehave. Their selfishness does not allow them to be able to work together on any project or endeavor of substance. When they do get together, their selfishness lets their egos get in the way of their goal Theirso-called help organizations seem to only want to promote their namewithout making any real change in their community.

They are content to sit in conferences and conventions in our hotels, and talk about what they will do, while they award plaques to the bestspeakers, not to the best doers. Is there no end to their selfishness? They steadfastly refuse to see that TOGETHER EACH ACHIEVES MORE (TEAM)

They do not understand that they are no better than each other becauseof what they own, as a matter of fact, most of those Buppies are but one or two pay checks away from poverty. All of which is under thecontrol of our pens in our offices and our rooms.

Yes, we will continue to contain them as long as they refuse to re ad,continue to buy anything they want, and keep thinking they are 'helping' their communities by paying dues to organizations which do little otherthan hold lavish conventions in our hotels. By the way, don't worryabout any of them reading this letter, remember, 'THEY DON'T READ!!!!
