Spiritual Baptists ring bells for Achong

Bells rang out and white candles, signifying angelic protection lit up the perimeter of the Point Fortin constituency office on Saturday night as Spiritual Baptists gathered to show support for Point Fortin MP Larry Achong.

The support was not only as he faces a magistrate in Point Fortin today on an obscene language charge, but to put their stamp on his selection as their choice of candidate for the forthcoming General Election.
Achong and his wife, San Fernando City Corporation CEO Marlene Coudray, sat in the front row under two large tents which were erected in the constituency’s Market Street compound as the Baptists sang and prayed for him.

Achong, who has been the PNM MP for Point Fortin for seven years, remains extremely popular in the constituency.

Out of 425 votes cast from nominees for this year’s Election, Achong received 400 votes.

McNICOLLS MISCONDUCT

While embattled Chief Justice Sat Sharma was on Wednesday suspended on the evidence-in-chief of his main accuser Chief Magistrate Sherman McNicolls, the Judicial and Legal Service Commission (JLSC) is yet to act on its own finding that McNicolls refusal to face the test of cross-examination on allegations he made against the Chief Justice amounted to conduct "prejudicial to the administration of justice" and that he should be slapped with a disciplinary charge of misconduct.

The body governing the judiciary has remained tight-lipped on its deliberations into allegations of misconduct against the Chief Magistrate which started well over two months ago. Instead, members of the Commission secretly elected to defer the question of McNicolls' own suspension because he is yet to deliver a decision on the Piarco Airport preliminary enquiry, after a near five years of hearing.

In an extraordinary development to the ongoing and unprecedented judicial saga of a sitting Chief Justice charged with two sets of impeachment allegations, the JLSC has determined that it would do the country more harm than good to suspend the Chief Magistrate while a decision was still outstanding on the Piarco Airport enquiry.

According to the minutes of several JLSC meetings obtained by the Sunday Express, two of the Commission's members, both retired Court of Appeal judges, expressed the view that it was not in the public interest to suspend the Chief Magistrate at this time.

The question of McNicolls' suspension was raised by Selby Wooding QC, who took the chairman's seat after acting Chief Justice Roger Hamel-Smith disqualified himself for personal reasons at a special meeting of the JLSC on March 8 this year. Wooding pointed out that the Commission was the only body with the jurisdiction to discipline the Chief Magistrate and was clear that "it ought to act swiftly and decisively".

Retired Court of Appeal judges, Lionel Jones and Jean Permanand, however, expressed strong reservations on the suspension option. Jones said he doubted that a suspension of the Chief Magistrate would be in the public interest. He was noted in the JLSC minutes as saying that McNicolls was involved in a number of "important matters and his suspension could have serious repercussions".

Justice Permanand supported Jones' position, noting that: "The Commission needed to consider whether the public interest would be served by such action". In response to an enquiry from another JLSC member

Christopher Thomas, Justice Jones said that: "If the Chief Magistrate was suspended the cases he was handling would have to be restarted or deferred".

Wooding, however, made it clear that "he felt very strongly that one should not have a Chief Magistrate who had ostensibly made a mickey mouse out of the administration of justice, continuing to preside in court while allegations of misconduct were under investigation".

He referred to the complaint of deputy Director of Public Prosecutions Carla Brown-Antoine who blamed the dramatic fall of the criminal case against Sharma on McNicolls' refusal to have his evidence tested on cross-examination. But Justice Jones was equally firm that "it would do more harm than good to suspend the Chief Magistrate".

At the end of the specially convened March 8 JLSC meeting held at the Hall of Justice, agreement was reached on the following:

- that the Legal Adviser be asked to draft allegations of misconduct against the Chief Magistrate
- to appoint Justice Sebastian Ventour as investigating officer to enquire into the allegations and misconduct drafted against Chief Magistrate McNicolls
- issue a press release on the matter
- defer the question of suspension

At another meeting of the JLSC, this one on April 24, 2007, Thomas raised the issue of McNicolls' current list of high-profile cases. He wanted to know just when "the Chief Magistrate would be free of critical cases"? The Commission's secretary Cheryll Hay informed the meeting that "it had been ascertained that the only critical case currently being handled by the Chief Magistrate was the Piarco case and he was due to hand down his judgment on the matter around May 24, 2007." McNicolls, however, indicated in May that he needed more time to look at the transcripts and he would give a decision in July.

And while members of the Commission privately weighed the merits of whether the disciplinary tribunal should comprise one or three persons and also whether retired persons could be used in the procedure that would follow the preferment of a disciplinary charge, they appeared nowhere closer to solving the McNicolls question of alleged misconduct while a verdict was still outstanding on the Piarco corruption case.

On the Ventour report, Wooding said: "It could be concluded from the report that the actions of the Chief Magistrate amounted to conduct prejudicial to the administration of justice". He said such a finding was not inconsistent with the facts presented in the case against McNicolls.

PM: New highway network coming

A COMPLETELY new highway network in five to ten years will allow commuters to get from one side of Trinidad to the next in two and half hours, Prime Minister, Patrick Manning said yesterday.

Manning linked productive levels to the effectiveness and efficiencies of a well integrated and improved road network and alluded to its development as critical to the country moving forward.

Stating just how Government intended to move forward with its comprehensive plan, he said all contractors interested in tendering will be notified that the job is on a concessionaire basis.
This, he explained, will result in contractors designing, building and maintaining highways, by toll system.

Manning said that the contractors will make back their money via the toll system.
After contractual agreements expire between government and contractors, they (contractors) will realise their investments and make profits and "in about 30 to 50 years, highways are handed back to government for its control".

"The point I'm trying to get at, is that it will not cost the Government money," the Prime Minister said.

Ah boy, the tun tun learn something from the UNC. This is how the UNC use to conduct they business, at no cost to the taxpayer.

Just imagine it take he and ah whole cabinet of monkeys 5 years to figure this out.

Residents rebuild bulldozed homes

Residents of Bagatelle, Diego Martin, whose homes were demolished earlier this week by officers of the Land Settlement Agency (LSA), have begun rebuilding the bulldozed structures.

Jahzeel, 21, and Jahmai Joseph, 19, of Savannah 1, Bagatelle, said yesterday they were left with no choice but to rebuild, as they are without any financial means to help themselves.

The brothers said they spent the last two nights in a makeshift shelter on the land, and although they have managed to rebuild the one-room structure, it remains exposed to the elements, as some of the galvanise which had previously been used had been badly damaged by the demolition crew.

Vowing to rebuild everytime the LSA bulldozed their home, Jahzeel said a visit to the LSA on Thursday proved to be fruitless, as he was turned away without any viable housing alternatives.
Questioning what exactly they were entitled to as citizens of the country, and as residents of Bagatelle, Jahzeel and Jahmai accused Government of using them at election time, and then turning their backs on them.

You know if dem fuckin coolie people in Aranguez (the Daniels) decide to goin to rebuild, you go see fuckin SWAT team in action. Rolling in wid Ak 47's, Bazooka's, Machine Guns, an army Tank, Bulldozer, excavator, foklift and whatever and run through the fuckin coolies and dem.

Saying the Red House or Whitehall could be next, Opposition Leader Kamla Persad-Bissessar is calling on the Government to explain why, to date, there have been no arrests in the four bombings in Port of Spain in 2005.

Persad-Bissessar raised the issue during the debate on the Bail (Amendment) Bill during yesterday's sitting of the House of Representatives, as she recalled Prime Minister Patrick Manning had said that the Government knew who Mr Big was.

She said this was the equivalent of Manning saying he "knoweth the man", making reference to his remarks denying that he knew one of the terror suspects charged with an alleged plot to blow up the JFK airport.

"He is the chairman of the National Security Council and what has happened? Up to now, Mr Big is out there planning his next step. He is out there planning his next dustbin bombing, or it may well be a Whitehall bombing or a parliamentary bombing but we have not found who this person is," Persad-Bissessar said.

Earlier, Manning sought to clarify his previous statements.

Acting CJ named

PRESIDENT George Maxwell Richards yesterday brushed aside objections made by Opposition Leader Kamla Persad-Bissessar and appointed senior Appeal Court Judge Roger Hamel-Smith to perform the functions of Chief Justice.

Hamel-Smith received his instrument of appointment at President's House, in St Ann's, during a low-keyed ceremony and the media were not invited to the event.

Judiciary sources said that they hope Hamel-Smith's appointment will once again bring some calm to the administration of justice and help restore public confidence in the judicial system and re-open the doors for speedy negotiations with the Executive on several issues.

The President suspended Chief Justice Satnarine Sharma from office on Wednesday, based on Prime Minister Patrick Manning's recommendation.

No one was immediately appointed to fill the vacancy of the top judicial post, creating a scenario where for the first time in the country's history there was no sitting Chief Justice.

The situation affected the issuing of subpoenas from the criminal registry and other court orders which had to be delayed until the appointment of an acting Chief Justice, judiciary officials said yesterday.

Richards did not immediately appoint a replacement, the Express was told, because he wanted to first get the views of the Opposition Leader as required under the Constitution. Persad-Bissessar had previously objected to the President seeking her views over the telephone.

Section 103 of the Constitution requires the President to appoint an acting Chief Justice after consultation with the Prime Minister and the Opposition Leader.

Aint ah say yesterday that these fuckers wanted to appoint Roger real bad to act as the CJ!

“I TOOK the deal of a lifetime for my country...” declared Arthur Joseph moments after winning a surprise prize on the NBC game show Let’s Make a Deal on Wednesday night.

Apart from the US$70,700 he won, the US-based Point Fortin man accepted a deal that included a basketball court in his native Trinidad, courtesy the 2006 NBA champs The Miami Heat.
Yesterday, in a telephone interview from his office at Carnival Cruise Lines where he works as a personal vacation planner in Miami, Joseph recalled how he gave up his pursuit of the ultimate US$1million prize to do something meaningful for his country.

“What would you give up a million dollars for?” he asked rhetorically.

“I did it for my country. If that offer of a basketball court wasn’t there, I wouldn’t have done it.

“My philosophy has always been: the needs of the many outweigh the needs of the few.”
