RESULTS of the new assessment examinations will not be used for promotion to and within the First Division of the Police Service until the hearing and determination of a lawsuit brought by the Police Social and Welfare Association.
In a statement yesterday, Police Commissioner Trevor Paul said he wanted a correction to media reports that he had decided not to use the results for promotions.
On Monday, at least 117 First Division officers sought an injunction preventing yesterday’s and today’s examinations from taking place.
It was agreed that the examinations would take place but Paul, who was present in court on Monday, gave the assurance that none of them would be promoted based on the two-day assessment process until their lawsuit was determined.
A hearing for leave to apply for judicial review is expected on Friday.
After the case was heard on Monday, Commissioner Paul declined to speak to the media, instead directing all questions to the attorneys in the case which was heard in private before Justice Judith Jones.
The policemen said the assessment process was unfair, since they had not been given sufficient time to prepare.

CWU: TSTT cable theft ‘political’

Communication Workers’ Union (CWU) president John Julien yesterday claimed that acts of vandalism of TSTT cable lines are meant to influence the electorate to vote out the Government, by suggesting it is unable to provide a reliable telecommunications service.
Julien said the union had observed that the vandalism, the most recent incident being Monday’s destruction of cable lines in several areas in San Fernando, had increased in opposition strongholds in Central Trinidad.
“One can only assume that this is an attack against TSTT, more so the Government, to make the Government appear not able to provide service and therefore allow the public to lose confidence in TSTT and their ability to provide proper service,” said Julien. He made the claims during a media conference at the CWU’s headquarters, Henry Street, Port-of-Spain yesterday.
Julien said the CWU did not have faith in TSTT’s own investigations of the cable theft, nor those of the police, and believed the Government, as the majority shareholder in TSTT, should undertake its own probe of the upsurge in cable theft. He said TSTT’s explanation that the fibre optic cables were being stolen for copper was not the real reason behind the acts of vandalism.
Apart from the political motive, Julien said research done by the union suggested the vandalism was aimed at making TSTT appear to be unreliable, therefore improving the image of its competitors.
Julien questioned the theory of the theft for the sale of copper stating “cable has been cut and left on the ground.”
The CWU advised that TSTT should abandon the contract system for the installation of cables and have the lines buried and manholes locked which, Julien said, TSTT was “quite capable of performing with minimum costs.”
Julien also called on the Government to conduct an audit of TSTT “to determine the extent of and to put a stop to the hemorrhaging of funds of the company.” TSTT recently posted a $122M loss for the 2006 fiscal year.

Fleas follow Dog
Prime Minister Patrick Manning remained at work at Whitehall, Port of Spain, yesterday, while some employees went home early, as fleas invaded parts of the compound yesterday.
The affected areas are expected to be cleared for workers to resume duties today.
Office of the Prime Minister communications manager Paige De Leon said yesterday afternoon the areas on the Whitehall compound that were affected did not include the location where Manning's office is located. (fockin lie)
"He was unaffected by the problem. When I left Whitehall this afternoon, the honourable prime minister was still in his office doing his work," De Leon said.
In a statement yesterday, Whitehall said that members of staff on the compound reported that they observed fleas when they arrived for duty.
"As a result, the Ministry of Health and the Insect Vector Control Division were called to Whitehall to conduct investigations.
In order to facilitate the spraying exercise, it was necessary to have staff vacate the affected work areas," the statement said.
When contacted for an update yesterday afternoon, De Leon said the Insect Vector Control Division officials treated the affected areas sometime after midday.
"We expect work at the Office of the Prime Minister will resume as normal tomorrow morning," De Leon said yesterday.
She said some work at the Office of the Prime Minister was affected as some employees had to be sent home yesterday but did not describe the disruption as significant.
Adult fleas often live as parasites on warm-blooded mammals, mostly cats and dogs, but do not always stay on their hosts and wall to wall carpeting create ideal conditions for the larvae to breed.
Whitehall is 95 years old and has been the location of the Office of the Prime Minister since 1961, and has been refurbished twice within recent times.
The Office of the Prime Minister is set to be relocated from Whitehall to a new building under construction at St Clair that was originally set to house the Public Administration Ministry.

JUNIOR Finance Minister Christine Sahadeo has pledged her government’s support in dealing with the perpetrators involved in Friday night desecration of the landmark Sewdass Sadhu Hindu Temple by the Sea.
“I’m in discussion with the Ministry of National Security as this will not be tolerated,” she told spectators gathered yesterday at the Ato Boldon Stadium for the 6th annual Maha Sabha National Hindu Youth Organisation (NHYO) Sports Day.
“It is unacceptable.” Sahadeo said the Government “will do all in its power to deal with the culprits” as all religions are allowed to worship uninterrupted in Trinidad and Tobago.
On Friday night, vandals entered the Waterloo temple, smashed murtis, piled up the pieces in the centre of the altar and attempted to burn it down. The vandals also destroyed carpets, electrical wiring, lights, glass windows and concrete pillars — cost of damage is estimated at more than $100,000.
Sahadeo who took time out from her cabinet retreat being held in Tobago to attend the annual sports day, addressed spectators as she stood on the track — without an umbrella in the pouring rain.
She praised the NHYO and its governing body Sanatan Dharma Maha Sabha for the organisational skills.

Political parties, organisations and individuals opposed to the ruling People’s National Movement (PNM) are being urged to desist from using race and religion to divide T&T in the run-up to this year’s general election.
Making the appeal yesterday, Agriculture Minister Jarrette Narine said such action could prove detrimental to the impending polls.
The minister’s call came in the wake of Friday’s vandalism of the Siewdass Sadhu Shiva Mandir—also known as the Temple in the Sea—in Waterloo, Carapichaima.
“I have been listening over the last two days, and the Opposition parties in T&T have been trying to make a lot of political mileage out of this,” Narine told a news conference at the Ministry of Agriculture’s headquarters in St Clair, Port-of-Spain.
“This is an election year, and I am appealing to these people who have tried to divide this country by race.
“And now they have not succeeded, they are trying through religion.
“I am appealing to them that this could be detrimental to the upcoming general election and to the people of T&T.”
Narine, who became a member of the PNM in 1963, said he was involved actively in politics for the past 25 years, and had never been discriminated against by the party.
Delivering the Government’s official response to the incident, Narine said:
“It is unfortunate, and the Government and everyone in the PNM would like to condemn this action taken by—I would call them cowardly people—who had gone to the mandir and desecrated it.”
He told reporters the PNM felt that, based on statements made in the media, “sufficient facts were not coming out, in that we were being made the scapegoats for it (vandalism).”
In fact, Narine stressed that it was the PNM that had reconstructed the mandir during its 1991-1995 tenure, at a cost of $1.5 million.
The minister said after the mandir was rebuilt, a committee was established. It comprised former Speaker of the House of Representatives Occah Seepaul, members of the the Sadhu family, among others.
However, Narine said by the time the monument was completed, the PNM administration had taken “a political decision at that time not to open it, since it was close to a general election.
“However, after the election it was opened. I was invited. I chose to sing a bhajan instead of giving a speech.
“Mr (Basdeo) Panday was then the Prime Minister of T&T, but the mandir was built long before he came into office.”
The Sanatan Dharma Maha Sabha, the UNC Alliance and the Congress of the People have all condemned the incident.

Judge’s home burglarised

THE HOME of a High Court Judge at 19 Grenada Avenue, Federation Park, was broken into at about noon yesterday.
High Court Judge Justice Joan Charles left her home at about 11.30am.
Another occupant of the house, Beverly Samuel, returned at 12.30 pm to find that it had been broken into.
According to police, burglars gained entry by cutting through a burglar proofing along the western side of the house. A laptop computer was among the items stolen.
Police were on the scene yesterday afternoon.
The temporary residence of Prime Minister Patrick Manning is a few blocks away from the house on St Kitts Avenue. Sgt Agith Persad of St Clair Police Station is investigating.
Oh gawd, ah cyah wait for dem to break in to Martin Joseph house and Manning one too and leh we hear the fockin lame ass excuse about fockin crime in the country.
Dey done teefin in the Ministry of Education offices already. But please god let it happen nah.

State spent TT$1.4M to prosecute CJ

THE STATE incurred at least TT$1.4M in legal costs in the failed criminal prosecution of suspended Chief Justice Satnarine Sharma, bringing the base total of this case as well as the Court of Appeal case in which a conviction against former Prime Minister Basdeo Panday was quashed up to TT$ 3.5M.
Sunday Newsday had previously estimated a base-figure of $3.25 M for both matters, after obtaining pro forma invoices from the Ministry of the Attorney General, which is responsible for approving legal fees on behalf of State agents and for approving the appointment of legal counsel.
The figure broke down into a total of TT$1,123,600 in legal costs for fending-off a challenge of the criminal matter against Sharma all the way to the Privy Counsel as well as $1,328,700 in legal fees for Queen’s Counsel Sir Timothy Cassel up to April 25, 2006 in the Basdeo Panday Integrity trial as well as conservative estimation of TT $797,220 for Cassel’s fee in the Panday case when it went to the Court of Appeal.
The Appeal was re-opened days after the collapse of the criminal case against Sharma. Sharma was ordered to pay costs for his challenge to the criminal charges at the Privy Council.
To date the cost of retaining British barrister Michael Beloff QC, who legal sources say is one of the most expensive barristers to retain in London, has never been disclosed. Beloff, a former President of Trinity College, Oxford, appeared for the State at the Privy Council.
None of these costs include the economic cost of diverting state resources, such as the efforts of employees in the Office of the Director of Public Prosecutions (DPP) and other government agencies, into the pursuit of these court matters.
The amended base total is a result of Sunday Newsday obtaining the legal costs of the Sharma preliminary inquiry which stalled before Senior Magistrate Lianne Lee Kim on March 5 after Chief Magistrate Sherman Mc Nicolls, Sharma’s chief accuser, refused to be cross-examined.
By letter dated July 31, 2007, the Permanent Secretary of the Ministry informed Sunday Newsday that the State, “in fulfilment of its obligations to the people of Trinidad and Tobago” incurred $238,000 for hiring Senior Counsel Gilbert Peterson who prosecuted the matter.
The Ministry has not, however, provided the cost of retaining Sir Timothy Cassel for the Basdeo Panday Court of Appeal case. All in all Cassel’s fee from June 6, 2005 to April 25, 2006, when he was working in the Integrity Trial in the Magistrates’ Court, was $1,328,700 (GBP 103,000), according to a pro forma invoice dated September 1, 2006.
Using this ten-month period to produce a rough estimate of legal fees per month at TT$132,870, one could conservatively tabulate that the final quantum of fees would add something like sixth month’s work from October 2006 to March of this year) at TT$ 797,220.
This pushes Cassel’s grand total to at about TT$2,125,920. The suspended Chief Justice, who is now the subject of a Tribunal appointed to investigate the claims of misconduct levelled against him, had been charged with attempting to interfere with the 2006 Basdeo Panday Integrity Trial.
But on March 5, Deputy Director of Public Prosecutions Carla Brown-Antoine was forced to discontinue the proceedings against him because of Mc Nicolls’ “position.”

THE STATE incurred at least TT$1.4M in legal costs in the failed criminal prosecution of suspended Chief Justice Satnarine Sharma, bringing the base total of this case as well as the Court of Appeal case in which a conviction against former Prime Minister Basdeo Panday was quashed up to TT$ 3.5M.
Sunday Newsday had previously estimated a base-figure of $3.25 M for both matters, after obtaining pro forma invoices from the Ministry of the Attorney General, which is responsible for approving legal fees on behalf of State agents and for approving the appointment of legal counsel.
The figure broke down into a total of TT$1,123,600 in legal costs for fending-off a challenge of the criminal matter against Sharma all the way to the Privy Counsel as well as $1,328,700 in legal fees for Queen’s Counsel Sir Timothy Cassel up to April 25, 2006 in the Basdeo Panday Integrity trial as well as conservative estimation of TT $797,220 for Cassel’s fee in the Panday case when it went to the Court of Appeal.
The Appeal was re-opened days after the collapse of the criminal case against Sharma. Sharma was ordered to pay costs for his challenge to the criminal charges at the Privy Council.
To date the cost of retaining British barrister Michael Beloff QC, who legal sources say is one of the most expensive barristers to retain in London, has never been disclosed. Beloff, a former President of Trinity College, Oxford, appeared for the State at the Privy Council.
None of these costs include the economic cost of diverting state resources, such as the efforts of employees in the Office of the Director of Public Prosecutions (DPP) and other government agencies, into the pursuit of these court matters.
The amended base total is a result of Sunday Newsday obtaining the legal costs of the Sharma preliminary inquiry which stalled before Senior Magistrate Lianne Lee Kim on March 5 after Chief Magistrate Sherman Mc Nicolls, Sharma’s chief accuser, refused to be cross-examined.
